Austin (KXAN) – A bill introduced this week in the Texas House of Representatives threatens to criminally claim transgender Texans to identify genders that are different from those assigned at birth.
HB 3817 would make a state prison felony for a person to “identify” a state agency or private employer to “a biological sex assigned to a person assigned to a person who was born.”

Gwen Howerton, audience producer for the Houston-based publication Chron, reported on the bill on Wednesday. In a conversation with Kxan Anchor Will Dupree on Friday, she said the trans rights advocate she spoke to called the bill “Alarming.” She noted that the bill is unlikely to pass.
“[It] When talking about not only the extent to which the bill is saying, but also about the treatment of transgender individuals in prisons, Howerton said, “I would say it’s really low.”
She said the purpose of these bills might not actually pass, but instead move the conversation further into anti-trans views.
“Overton Window has moved so much movement into trans rights and laws, and the bills that arrived a few years ago are back. In fact, supporters say it’s more dangerous now.”
