San Diego Middle School has agreed to eradicate the suspension of students accused of attending a soccer game on Blackface in 2023.
The student and his parents sued Muleland Middle School after October 23, 2023, saying that teens wear eyes rather than blackface, and that it is a fashion trend among soccer and baseball athletes. Students who are only mentioned as JA in the lawsuit were first suspended for what they called “hatred cases.”
“Blackface’s false allegations regarding JA’s permanent school records have affected both his education and future career opportunities, and may have plagued him for decades,” said JA’s lawyer Karin Swigert. “It’s reassuring that the district has finally fixed this fraud.”
The incident occurred during a high school football game between La Jolla and Morse High School. JA’s father said no one in the game had accused his son of being black face at the time, and that black security guards encouraged the boy to wear face paint.
In a suspension notice awarded to the family, the principal of Muirlands Middle School said that the students “drawn their faces black at a football game,” forming a “offensive comment.”
However, after the student’s family filed a lawsuit, the school agreed to a February settlement and permanently sweep the suspension from JA records.
“He had a great evening without any problems,” the student’s father said at the time of the incident.
