Trump calls the wartime alien enemy law of 1798 and targets violent illegal immigrant street gangs.

Hours after a federal judge in Washington, D.C., President Donald Trump summoned the alien enemy law on Saturday, 1798, to rule that the law could not be used to target the designated foreign terrorist organization Tren de Aragua (TDA) and deport five Venezuelans.

In 1812, during the wars of World War I and World War II, wartime laws allowed the deportation of indigenous peoples and citizens of enemy nations was invoked three times.

All Venezuelan citizens over the age of 14 who are members of the TDA are in the United States, and any naturalized or legal permanent residents of the United States may be arrested, restrained, protected and removed as “an alien enemy.”

Hours before the law was signed, lawsuits were filed by the American Civil Liberties Union, Democracy Forward and the District of Columbia ACLU, claiming that the declaration could be used to deport Venezuelans in the country, regardless of whether they are members of the TDA or not.

US District Judge James E. Boasberg of the DC Circuit has granted a temporary restraining order that would prevent the deportation of five Venezuelans already in immigrant detention over two weeks.

The Trump administration appealed the restraining order, arguing that it was inappropriate to delay presidential actions before it was announced, Affiliate Fox 32 Chicago reported.

The second hearing is scheduled for Saturday afternoon and will establish whether the order should be extended to all those at risk of removal under the law.

“The US has not been invaded even during the war. The president’s expected wartime government call is not necessary to carry out legal immigration enforcement projects, but it is the latest step in accelerating the authoritarian playbook.”

“From American citizens who arrest inappropriately to violating the ability of their communities to worship peacefully, to inappropriately seeking to incite laws that are responsible for some of our country’s most shameful actions, this administration’s immigration agenda is just as lawless as it is harmful.”

A face-to-face hearing on the merits of the lawsuit is scheduled for Monday in DC.

The move fulfills the promise of the campaign at the October rally.

Tren de Aragua (TDA), designated as a foreign terrorist organization by the State Department on February 20th, has thousands of members.

Colorado officials confirmed that the TDA has taken over the entire apartment in Aurora and noted that a special task force must be established to combat the activities.

As of September 11, 2024, the Aurora Police Department had linked the gang to almost 12 people, resulting in the arrests of eight.

“Two of the eight people detained were involved in the July shooting on one of the city’s specific properties that experienced problems with TDA activity,” the statement said. “In line with these arrests, we can confirm that criminal activities, including TDA issues, have had a significant impact on these property.”

The White House said gangs are continuing their mass illegal transition to the United States to “promote the purpose of hurting American citizens” that undermine public safety.

The TDA is run in partnership with Cartel de los Salles, a Narco Terror Enterprise sponsored by the Venezuela-based Nicolas Maduro administration, and according to the White House, it commits brutal crimes including murder, trickery, terror, human trafficking of humans, drugs and weapons.

While Tarek El Aisami served as Governor of Aragua between 2012 and 2017, he grew significantly. In 2017, El Aisami was appointed Vice President of Venezuela.

Shortly afterwards, the Treasury designated El Aisami a drug trafficker specially designated under the Foreign Drug Kingpin Designation Act, and he remains a US fugitive.

In 2020, Maduro and other members of the administration were charged with narcoterism and other crimes in a suspected conspiracy against the United States.
