The federal judge’s 22-page decision on Sunday was called the “complete outlaw” of Kilmer Armando Abrego Garcia.

Abrego Garcia, 29, was deported to El Salvador’s MegaPrison last month for allegedly being a member of the MS-13 gang. US District Judge Paula Sinis ordered the Department of Homeland Security and Homeland Security Secretary Christie Noem to return Abrego Garcia to the United States, where he lived in Maryland.

“The legal basis for the removal of hundreds of individuals in large numbers to El Salvador remains uncertain, but the case of Abrego Garcia is decisively different. There was absolutely no legal basis for his arrest, detention or removal,” Xinis writes.

“The evidence that Abrego Garcia was also being held at CECOT at the request of Salvadorian authorities suggests that he would answer the crimes in that country. Rather, his detention seemed completely lawless,” she continued.

Also, on Sunday, Attorney General Pam Bondi doubled the Trump administration’s decision to deport Abrego Garcia.

“We have to rely on what Ice is saying,” Bondy said in an interview with Fox News Sunday. “We have to rely on what Homeland Security says. They are our clients and I firmly believe in the work they are doing. We are trying to make America safe again. That was President Trump’s instructions to all of us.”

The White House has decided to deport Abrego Garcia following reports from the Atlantic that federal lawyers said there was a “administrative error” when they took him to the Secott men’s prison in El Salvador.

According to a court application, Abrego Garcia came to the US at the age of 16 after fleeing gang threats in El Salvador in 2011, the outlet reported.

Abrego Garcia later married a US citizen and worked in the construction to support her, her son and her two children from previous relationships.

The allegations about partnering with MS-13 from a 2019 arrest outside the Maryland Home Depostore where he and other young men were looking for work, according to the Associated Press.

Jennifer Vasquez Sula, wife of Kilmer Abrego Garcia of Maryland, misrepresented her at a press conference at Casa’s Multicultural Center in Hyattville, Maryland on Friday, April 4, 2025.

Abrego Garcia was arrested in Baltimore on March 12 after shifting as a sheet metal apprentice in Baltimore and picking up her 5-year-old son, who has autism and other disabilities from her grandmother’s home, before being arrested in Baltimore on March 12, the lawyer’s complaint said.

Taylor Penley, Brie Stimson, Bill Mears and the Associated Press of Fox News Digital contributed to this report.
