A federal judge said Wednesday that he has determined that it is likely that he is emptied the Trump administration by failing to return two planes deporting immigrants to El Salvador last month. This was a major update as tensions between the Trump administration and the judiciary reached fever.
In a 48-page opinion, Judge Boasberg said the court ultimately determined that the Trump administration’s actions on March 15th deportation flights occurred after the issue of a bench ordering immediate return to the US soil.
If they did not answer his questions by April 23, he would introduce the matter to potential prosecutors.
Judge Boasberg planned a hearing to review Trump’s deportation
James Boasberg, Chief Judge of the District of Columbia, will be attending a panel discussion at the Annual American Committee Association (ABA) Spring Antitrust Conference held at Marriott Marquis in Washington, DC on April 2, 2025.
This includes identifying who is responsible for what he described as an “acceptable conduct” and “by determining whose ‘specific conduct or omission’ caused the violation,” Boasberg said.
The Justice Department can then request that light empt be prosecuted by government lawyers and if they refuse to prosecute the matter, they can “appoint another lawyer to indict light empt.”

“The court does not reach such conclusions lightly or in a hurry. In fact, it gave the defendants a sufficient opportunity to correct or explain their actions,” the judge continued. “None of their reactions are satisfactory…”
“As this opinion details, the court ultimately found that the government’s actions that day were intentionally ignoring the order and was sufficient to conclude that there is a possible cause for the court to find the government in criminal contense,” Boasberg said Wednesday.
