The Los Angeles County District Attorney’s Office filed an motion requesting delays in res court hearings for Eric and Lyle Menendez one day before the brothers are due to return to court.
The DA’s office said it was important for the court to obtain a copy of the sibling’s comprehensive risk assessment, completed by the state prison and parole officer, before a res trial is held. The brothers were scheduled to face a judge for Thursday and Friday’s hearings.
Mark Jelagos, the Menendez brothers’ lawyer, did not comment on the matter.
It is unclear whether the motion will affect defense hearings. The judge was scheduled to hear discussions about the suitability of Eric and Lyle’s resemble.
The two brothers have spent time at the back of the bar for the murders of their parents, Jose and Kitty Menendez in 1989.
Da Nathan Hochman, LA County, opposed restinsing, saying the brothers were not yet accountable for their actions. Most of Eric and Lyle’s relatives support a second chance for them.
