Life activist 40 days Mark Hooke discusses new charms in his fight with “activist” judge

First on Fox – life supporter Mark Hooke sued the Justice Department over arrests and prosecutions under the Biden administration, but said his family was being prevented from resolving the case by a “activist” federal judge.

Houck filed a lawsuit against the Department of Justice last year, seeking compensation for what he called “false investigation” and “overpowered power” after about 25 SWAT teams arrested him in front of his children.

Now Houck is appealing the judge’s decision to the Third District Court, asking the Trump administration to track down ending DOJ weaponization against pro-lifers like him. He discusses his wife and 40-day founder Shawn Carney in a new video shared with Fox News Digital.

“You live in fear of happening again not only to yourself but to others, and I want to know that this administration, which challenged the White House, is willing to step in,” Houck said in the video.

In an interview with Fox News Digital, President Shawn Carney for 40 Days said:

“No one likes that — but this guy is a victim,” Carney said. “This needs to be fixed,” the Justice Department added.

News of the appeal, scheduled to be filed in 40 days on Houck’s behalf, was only shared with Fox News Digital. The group has already filed a notice of appeal to the court.

The issue is a 40-day settlement negotiation that was concluded with the Department of Justice in early 2025, following Trump’s inauguration.

Bush’s appointee, US District Judge Paul Diamond, suddenly issued a motion to dismiss the case last month, effectively closing negotiations that were taking place between Houck and the Trump-led Department of Justice.

The motion to dismiss the lawsuit appears to have been filed by the Biden-led Department of Justice, which appears to have indicted Houck in 2021 for allegedly violating freedom of access to the clinic.

In the video, Carney and Hooke discussed changes to the law enforcement community and their hopes to become a new priority for the Second Trump administration, as well as judges’ decisions and changes.

Houck said his family was disappointed by the judge’s actions, adding that “it’s not reflected in the Trump administration.”

Speaking to Fox News Digital, Carney lamented Diamond’s dismissal of the lawsuit, calling it a “activist” judge and was accused of political bias. Nevertheless, he expressed confidence that the Trump administration would make it right.

“We are suing the judge’s decision to continue the case against DOJ,” Carney said. “And of course, if they can get back on track with that, they want to settle down, so the idea is that they can settle down with the DOJ.”

“We have a very strong appeal,” he said of their yet-to-financed brief. “We are very confident in our appeal.”

The FBI and the Department of Justice did not respond to requests for comment.

Houck, a longtime 40-day volunteer, was arrested in 2021 for behaviour other than Planned Parenthood Clinic.

He was acquitted by a Philadelphia ju judge, but if convicted he could have faced him in prison for up to 11 years.

His famous arrest at home and the long prison sentence he faced if convicted, prompted anger from a pro-life group that included 40 days of life that Houck has volunteered since 2007.

In 2023, after Houck’s acquittal, Houck sued the Justice Department over the trials in 2023, accusing law enforcement officials of conducting “false investigations” on him, and accusing law enforcement agencies of using “excessive force” in the FBI attacks of a family home.

Kearney has previously focused on topics, and in this year’s X post, he states that his 40 days of life is “constantly targeted by Biden DOJ.”

“Together with 1,000,000 peaceful volunteers, we will always fight for life support and freedom of speech for pro-aboration Americans.
