Federal judge orders the Trump administration to return the second deported immigrant

A second Maryland judge ordered the Trump administration to return another man who was deported from the United States to El Salvador last month under alien enemy law.

Trump’s appointee, US District Judge Stephanie Gallagher, ruled Wednesday that the Trump administration breached a settlement agreement reached with a group of young asylum seekers last year.

He was part of an immigrant group that illegally entered the United States as an unaccompanied child, and later filed an asylum claim to remain in the United States.

The DHS has agreed to a settlement that it will refrain from deporting any of the individuals in its class until the asylum claim has been fully awarded by a US court.

Gallagher ruled that when the government deported Christian, a member of the class, violated the agreement and ordered him to return to the United States.

News of the incident and settlement in question were first reported by ABC News.

Gallagher stressed in her ruling that unlike other court challenges to Trump’s deportation under the alien enemy law, this focuses on “breach of contract” by the government.

Her ruling also hinted at the deportation of Abrego Garcia, a MS-13 member living in Maryland, who was deported to El Salvador last month. US officials resisted court orders to promote return to the US

In response, Gallagher specifically appointed the Trump administration by making a sincere request to the Salvadoran government and making a sincere request to approve Christians to be detained in the United States for transport to the United States in awaiting awards on his asylum application for merit by the USCIS.

Meanwhile, the Trump administration told the court that he was arrested and convicted earlier this year for possession of cocaine, which determined Christians were eligible for removal under the alien enemy laws.

They told the court he “stop becoming a member of the rank he negotiated a settlement as an alien enemy based on the AEA.”

The agreement appeared to have no water held with Gallagher. Gallagher ordered the government not to exclude other members of the class until the asylum claim has been properly awarded.

“Therefore, under the obvious terms and fundamental tenets of the settlement agreement and contract law, the removal of class members from the United States, including but not limited to Christians, without a final decision by USCIS regarding pending asylum applications for class members, would violate the settlement agreement,” Gallagher said.

She also gave another member of the class a temporary restraining order to another member of the class, as reported by the ABC.

Gallagher agrees that Javier is subject to a settlement with the government and blocks its removal from the US.
