Democrat New York Gov. Kathy Hochul announced a $254 billion budget deal on Monday.
The extra charge could only apply if the suspect is charged with a Class A misdemeanor or a more serious claim, Hochul said. Lawmakers agreed to reduce mask penalties to Class B misdemeanors when prosecutors claim separate crimes, Politico reported.
The governor initially wanted stricter laws to combat suspects wearing masks, and raised the issue last summer as politicians across the country tackled widespread protests against the Israel-Hamas war in Gaza.
Nassau County, New York, is trying to prohibit people from standing within 15 feet of officers under buildings deemed unconstitutional.

“We are trying to focus on people wearing masks when it comes to hiding their identity while committing another crime,” Senator Karl Heaty told reporters.
The additional fee also applies to those who flee the scene of crime.
Hochul wanted to create an additional penalty if someone covered their face while threatening or harassing a group of people. This is a proposal that was softened this week before the agreed bill was added this week, following concerns from Democrats and civil liberty advocates.

Annual budgets that are effective until lawmakers resolve some spending decisions allow hospitals to involuntarily commit New Yorkers mentally and mentally if patients are unable to meet their basic needs.
Other suggestions in the budget include stronger state discovery laws to address recidivism and ban the use of mobile phones by students.
New York’s proposal prohibits police from banning traffic stops for minor violations to pursue “racial equity.”

Hochul announced its budget contract on Monday, but politicians say lawmakers will need to hash spending decisions on several issues, including public schools and Medicaid fundraising ceremonies.
The governor’s spending plan is the highest in state history and is set at $100 billion more than the state budget a decade ago, the outlet reports. Increased prison expenses and additional healthcare, childcare and education spending increased the size of the budget by $2 billion over what it proposed in January.
