Defense asks the judge to remove the LA District Attorney’s office from Menendez case

The judge hears an allegation Friday demanding the Los Angeles County District Attorney and his entire office be excluded from highly publicized cases, including the possible responsibilities of convicted murderers Eric and Lyle Menendez.

The allegations were filed by defense attorneys who allegedly biased by district attorney Nathan Hochman and the DA’s office against their brothers.

“My family doesn’t want to go through this charade with the DA any more,” said lawyer Mark Geragos. “What’s clear to everyone is that he still has some synapses that are fired, this is a DA who has set his mind and has never worked so hard in his position.”

The Menendez brothers were sentenced to life in prison in 1996 without the possibility of parole for the shotgun murder of their parents, Kitty and Jose Menendez at their Beverly Hills home.

Hochmann believes that his brothers, who were 18 and 21 at the time, are not fully responsible for the crime, citing the violence in their actions.

“This murderous atrocity,” Hochman said. “The 13 shotgun explodes. Again, one behind the father’s head. One to his mother in the blissful range lying while dying on the ground.

Former Da George Gascon recommended his brothers cut sentences in October, but Hochman, who was elected to the office in November, opposed the resting.

Professor Jessica Levinson of Loyola Law School described the allegations for removal as highly offensive. “They want the entire office, not only to have one or two prosecutors disqualified,” Levinson said.
