As Lyle and Eric Menendez continue to seek freedom, a Los Angeles judge will decide at a court hearing set next week whether to include a report assessing how dangerous the brothers will be.
After months of legal disputes between the LA County District Attorney’s Office and the Menendez brothers’ defense team, Judge Michael Jessick determined Friday that resententedenceding hearings could potentially reduce the number of siblings.
The judge rejected yet another request to rescissententenging the district attorney’s resententenging recommendation, but Jesic said he would consider other DA petitions.
What is a comprehensive risk assessment?
Comprehensive risk assessments are usually conducted by public safety experts and board-certified psychologists on behalf of the California State Parole Board before inmates are on parole.
Gov. Gavin Newsom ordered a risk assessment for Erik and Lyle Menendez to determine whether the brothers pose a threat to public safety in the 1989 shotgun murder.
During Friday’s hearing, District Attorney Nathan Hochman asked the judge to admit to risk assessments in the Res case, claiming that the report provided insight into the brother’s current and potential threats to society.
But the brother’s defense attorney, Mark Jelagos, argued that the risk assessment was a risk assessment that “weaks what the brothers’ amazing work of 35 years is.”

Hochman said the brothers were rated as having a “moderate risk of violence” for prison control violations.
“In January 2025 (Erik Menendez) took an illegal cell phone into the prison setting and joined in to do it for another prisoner and for him,” Hochman said.
The assessment report stated that while Lyle had a “narcissistic tendency,” Eric was vulnerable to the influence of others.
Geragos argued that the report should not be included in consideration of restinsing due to its preliminary status.
A final hearing regarding the risk assessment is scheduled for June 13th, 2025.
Why is sibling risk assessment important?
It is an important part for both prosecutors and defense as it may affect the ongoing res tiangling hearing in LA County and generous consideration in Sacramento.
Newsom said it would decide whether to issue tolerance to the siblings after the parole board’s risk assessment is completed.
Newsom said once the assessment report is ready, his office will submit it to the judge for restinsing, conducting its own independent analysis to determine whether to support the brothers’ commute.
