Texas bill requiring sheriffs to work with ICE will receive initial approval

The Texas House first approved a bill Saturday requiring sheriffs to cooperate with U.S. immigration and customs enforcement by serving federal immigration warrants in local prisons.

According to Fox 7 and the Texas Tribune, GOP State Rep. David Spiller, sponsoring the bill, revised the bill, and GOP State Rep. “This bill is not immigration reform,” Spiller said Saturday. “This bill is the strongest border security bill (indirectly) that can do this session.”

The measure requires a separate House vote before returning to the Senate. They must either agree to the change or straighten their differences before the Senate can send both rooms to Greg Abbott’s desk.

“Governor Abbott has made it clear that Texas cities and counties must fully cooperate with the federal government’s efforts to arrest illegal immigrants, to jails, prisons and prisons,” Abbott’s Deputy Press Director Eduardo Leal said in a statement to the Texas Tribune. “The governor will review this law as it does with the law sent to his desk that will help him achieve that goal.”

Under the bill, sheriffs must request a partnership with ICE, known as the 287(g) contract.

Under the agreement, ICE allows local authorities to authorize certain types of immigration enforcement in local prisons.

Local officials can also allow people to question the situation of immigration during “daily police duties,” including DUI checkpoints.

The bill also allows the Texas Attorney General to sue sheriffs who fail to comply with the contract. The sheriff must at least enter into a “warrant service” agreement. They may choose to enter into other contracts to meet the requirements.

Additionally, the proposal provides grants to the sheriff to offset participation costs that have not been reimbursed by the federal government.

As of Friday, 72 Texas law enforcement agencies had signed a 287(g) contract with ICE, according to data released by ICE. The contract was pending for four other sheriff’s offices.

Approximately 20% of contracts being implemented between Texas law enforcement and ICE are for the “task force model,” which expands immigration authorities to officers who fulfill their routine police duties.

While the law filed by GOP state senator Charles Schwartner could help the Trump administration’s massive deportation plan, immigration rights advocates say the requirements will lead to racial profiling of black and brown people, leading to quick fear among undocumented Texans without asking them to report crimes, report crimes from authorities working with ice, or cooperate with ice, according to Texas Living.
