Democrats shift the deportation fight to a “legitimate process”

Chad Pargram, a senior congressional correspondent at Fox News, joined the “American Newsroom” to discuss Democrats’ support for deported Salvador Kilmer Abrego Garcia, turning the fight into a legitimate process of illegal immigration.

The Trump administration told a federal judge on Wednesday that it was working to charter planes to bring immigrants from Guatemala who were deported in March despite fears of persecution in March back to the United States.

The Justice Department said in court Wednesday that they were working to bring back the individuals identified in the United States only as OCGs.

This update is important, showing the first known case in which the Trump administration appears to be complying with the United States with federal court orders. Administration officials who have admitted to the US as a result of misinformation will return deported immigrants.

The news comes after Massachusetts US District Judge Judge Brian Murphy ruled last week that a man identified solely as an OCG was deported to Mexico without justice, and that the administration ordered him to secure his return to the United States.

A Trump administration lawyer told the court late Wednesday that the ICE Enforcement and Removal Operations (ERO) Phoenix Field Office had contacted OCG’s lawyers over the weekend, “currently dealing with ice air will bring OCG back to the United States on the Air Charter Operation (ACO) fly-return leg.”

The update comes after Judge Murphy rejected a request from the Department of Homeland Security on Friday and revised his previous order that required the Trump administration to “take all immediate measures” to return individuals to the United States.

Murphy also emphasized that he was not given the opportunity to challenge his removal to a country that could face the threat of torture.

These “rational fear interviews” are given to immigrants under US and international law, and provide an opportunity to formally seek protection from removal if there is a reasonable fear of persecution or torture in a country.

In his ruling, Murphy said that OCG was previously detained for ransom and raped in Mexico, but his lawyers said he was not given the opportunity to assert those horrors before his removal.

“In general, this case does not present any particular facts or legal situations. It only presents the mediocre fear that a man was unfairly loaded onto a bus and sent back to a country that was allegedly raped and lured,” Murphy said Friday.

“The return of OCG raises a tiny cost that would vanish to allow us to argue that we are still meeting that ideal,” he added.
