The landmark Hollywood Roosevelt Hotel was sued today by a nearby resident who said the facility’s air conditioning and heating systems rattle his apartment.
Douglas Marxon is seeking unspecified compensatory and punitive damages in a private nuisance lawsuit in Los Angeles Superior Court.
“The plaintiff was so weakened by noise and vibration that he was unable to work,” the lawsuit states.
Hotel representatives did not immediately reply to requests for comment.
Marxon, 45, is a longtime tenant of his squad on Hawthorne Avenue, and in August 2023 he says he began hearing “excessive and permanent noise” from the HVAC systems, compressors, chillers and large industrial fans behind the hotel.
“The intensity and persistence of the noise and vibration not only prevented the plaintiff’s quiet enjoyment of his residence, but also caused physical discomfort and medical symptoms, including sleep disorders, stress and neurological problems requiring neurodiagnosis.”
Hotel management has been repeatedly told that 24/7 noise is disrupting both Marxon and other nearby residents, and the city has issued an order to the facility regarding the matter, but Roosevelt “deliberately failed to soften the terms,” the lawsuit alleges.
The Roosevelt administrator also “knows or should have known,” Suit further states that operating such equipment in its current state and configuration would result in continuous and excessive noise and vibration.
The Roosevelt website includes photos of Marilyn Monroe relaxing in the pool, and also points out that Charlie Chaplin was a guest.
