The Supreme Court on Friday again cleared the way the Trump administration strips its temporary legal protections from hundreds of thousands of immigrants, pushing the total number of new potential deportations to nearly one million.
The judge lifted a low-court order that maintains protections for humanitarian parolees for more than half a million immigrants from four countries: Cuba, Haiti, Nicaragua and Venezuela. The court also allowed the administration to revoke its temporary legal status from around 350,000 Venezuelan immigrants in another case.
Republican President Donald Trump has pledged and inaugurated the campaign trail to deport millions of people, and has sought to dismantle the Biden administration’s policies that created ways for immigrants to live legally in the United States.
According to court documents, Trump amplified false rumors that Haitian immigrants, who have legal status in Ohio, who have legal status under the humanitarian parole program, are accusing and eating pets during their only discussion with President Joe Biden.
His administration filed an emergency appeal with the Supreme Court after a federal judge in Boston blocked the administration from pushing for the program to end.
Judge Kentanji Brown Jackson wrote in dissent that the effectiveness of the court’s order is to “understand the lives of half a million migrants around us before the court decides on a legal claim.” Judge Sonia Sotomayor joined in on the opposition.
Jackson reflected what US District Judge Indira Talwani wrote that ending legal protections early would be a tough choice for people. Thalwani, an appointee of Democratic President Barack Obama, has discovered that parole can be revoked, but can be done on a case-by-case basis.
Her ruling came in mid-April, just before the permit was scheduled to be cancelled. The Court of Appeal refused to lift her order.
The Supreme Court’s order is not a final decision, but it means that protections are in place while the case progresses. He is now returning to Boston’s 1st Circuit Court of Appeals.
The Department of Justice argues that protections are always temporary and that the Department of Homeland Security has the authority to revoke them without court interference. The administration says Biden has granted a large amount of parole, and the law does not require that it be terminated individually.
Taking on each case individually is a “huge challenge” and slows down efforts to seek the removal of the government, D. Attorney General John Sauer argued.
White House Press Secretary Caroline Leavitt has blown up a federal judge who discovered that the Trump administration “arguably” had violated a court order by sending dispatchers to South Sudan. “The President and this administration want the Supreme Court to do what it takes to govern with these liberal activist judges.”
Biden uses humanitarian parole more than any other president and has adopted special presidential authorities that have been in effect since 1952.
The beneficiaries include 532,000 people who have come to the US with financial sponsors since late 2022, and as immigration lawyers have said, they were plagued by “instability, danger, deprivation.” They had to have financial sponsors to fly to the US at their own expense and qualify for a designation that lasts for two years.
Immigration lawyers said the Trump administration’s decision was the first mass disruption of humanitarian parole. They called the Trump administration’s move “the biggest mass illegal event in modern American history.”
The case is the latest in a series of emergency appeals the administration has made before the Supreme Court, many of which are related to immigration.
The court has opposed Trump in other cases. This includes slowing down efforts to quickly deport Venezuelans accused of being in a prison in El Salvador under 18th-century wartime law, known as the Alien Enemy Law.
