The proposed California voting initiative, named after the allegations of UnitedHealthcare CEO Killer Luigi Mangione, was permitted to begin collecting petition signatures on Friday.
The official name of the proposed measure restricts “the denial of medical insurance recommended by physicians and limits the Insurance Company’s Potential Liability, Initiative Act.”
The initiative “prohibits health insurance companies from delaying, rejecting or modifying medical care recommended by doctors.
If insurance companies are delayed, they must be proven with clear and convincing evidence that the medication or procedure is unnecessary or that it will not result in a disability, death, amputation, permanent appearance, or loss or reduction of physical function.
Under this initiative, people can sues insurance companies and receive attorney fees and high-pitched damages. This is three times the actual damage determined by the ju apprentice.
If an insurance company is facing a lawsuit, the insurance company must prove that it is not necessary for services or drugs or that the denial, delay, or change does not result in certain negative health outcomes, including death or disability.
Paul Eisner, a supporter of the measure, must gather signatures from 546,651 registered voters. This is 5% of the total votes cast to the governor in the November 2022 general election, and will take place in the general election to qualify for the vote.
Eisner has 180 days to distribute petitions for this measure. This means that the signature must be submitted to county election officials by November 26th.
