US District Judge James Boasberg on Wednesday ordered the Trump administration to give all non-citizens who have been deported from the United States to El Salvador’s largest security prison the opportunity to seek popular relief in court and challenge gang status.

The courts keep in mind that such remedies can involve sensitive diplomatic or national security concerns within the exclusive state of the administrative department, but they also have a constitutional obligation to provide remedies that “do the wrong thing.”
In particular, the order includes Kilmer Armando Abrego Garcia, an immigrant from Salvador who was deported from Maryland to El Salvador in March, and an MS-13 member who was recognized by the administrative authorities as an administrative error. That lawsuit alone touched on the fierce court battle, prompting an intervention from the Supreme Court in April.

He also ordered that planes carrying migrants removed by the law in question be returned to the United States “quickly.” This did not happen. The Trump administration is currently facing multiple court challenges over deportation flights conducted under alien enemy laws in March.
