The federal court of appeals refused last week to temporarily suspend interim district judges injunctions, preventing the Trump administration from moving forward with plans to dismantle the department.
Washington, DC and two states have previously requested courts to stop the announced DOE and Trump administrations cutting half of the remaining DOE employees (RIF) and closing the department.
The demolition was announced on March 11, 2025, and two days later, the superintendent of education, Linda McMahon and President Donald Trump were sued in the Massachusetts area.
Following the lawsuit, five labor organizations and two school districts did the same thing.

The plaintiffs requested the court to order an injunction against the transfer of certain functions from the department, Trump announced on March 21.
The district court merged the two cases and after reviewing the findings of the de facto investigation, it issued an order to halt the president’s actions.
The Trump administration appealed the decision and called for a temporary suspension of the district court order, but the request was denied on Wednesday.

“In this case, what is at stake in the crisis has discovered whether a Cabinet department for nearly half a century is allowed to perform statutory assigned functions or is prevented from doing so by the large termination of employees aimed at effectively closing the department,” the Court of Appeals wrote. “ Given the extensive findings made by the District Court and the lack of evidence of objection submitted by the appellant, we conclude that the appellant’s motion to stay does not guarantee interference with the usual course of the appellant’s award, which indicates that the record is the obvious result of doing so.
Republican senators introduced “educated education back to our state’s laws” in April after Trump signed an executive order to close the DOE in March.
If passed, the bill would redirect parts of the department to other federal agencies, including the Department of Home Affairs, the Department of Treasury, the Department of Health and Human Services, Labor, Defense, Justice, and the State.

“The Department of Education was created to collect education data and advise state and local organizations on best practices,” Sen. Mike Rounds of R-South Dakota told Fox News Digital at the time. “Since then, it has grown into an oversized bureaucracy that determines all policies, standards and practices of one size for students across the country.”
The bill has been widely supported by Republicans, eliminating agencies including current sitting education secretary Linda McMahon, and detailed the “vision of eliminating the Department of Education” on Fox News Opeda.
McMahon and Rounds recently held a meeting where “Act on Returning Education to Our State” was discussed.

In addition to eliminating government agencies, the law makes important changes to education compliance requirements, eliminating the need for schools to manage standardized tests to identify schools (CSI and TSI). The bill allows schools to set more autonomy with teacher certification standards and professional development plans.

The Republican-led bill could potentially accompany President Donald Trump’s executive order and campaign promises, and promises to rebuild the American education system.
