A Guatemalan man deported to Mexico returned to us after court order

A Guatemalan man was deported to Mexico. Mexico landed in the United States on Wednesday as President Donald Trump’s administration was trying to take it home after a court order, his lawyer confirmed.

The man, identified in court documents by Initial OCG, landed in California via commercial aviation airmail and contacted his legal team while waiting to pass US customs and border protections, said Trina Lelmuto of the National Immigration Litigation Alliance.

He was later detained by US immigration and customs enforcement agencies and was taken to a detention facility in Arizona, she said in an email to the Associated Press.

The Trump administration said last month that days after a federal judge ordered him to promote his return, he was working to bring him back after being deported to Mexico, despite fears that he would be harmed there.

The U.S. Department of Justice did not immediately respond to requests for comments and details from the Associated Press.

The gay man was protected from being returned to his country under the orders of the then US immigration judge. However, the US took him on a bus and sent him to Mexico instead. This is the removal that U.S. District Judge Brian Murphy admitted to having “no similarity in the due process.”

Mexico later returned him to Guatemala, where court documents say he was in hiding.

Government lawyers said the so-called large-money parole packet was approved in court filings before returning home. This designation allows those who are not eligible to enter the United States to do so temporarily, often for reasons related to law enforcement or legal proceedings.

Previous court proceedings held that the man had put persecution or torture at risk if he returned to Guatemala. However, he was also afraid to return to Mexico. There, court documents say he was raped and forced while seeking asylum in the United States.

“To our knowledge, this is the first time since January 20th (the Department of Homeland Security) has promoted repatriation following a district court order,” Realmuto said.

The case is one of a series of federal court investigations into the recent expulsion of the Trump administration. These include other deportations to third countries and the false deportation of Kilmer Abrego Garcia, an El Salvadoran man who lived in Maryland for about 14 years.

The US Supreme Court has rejected the White House’s allegation that Abrego Garcia ordered the Trump administration to return to the United States from the infamous Salvador prison, and failed to retrieve him after accidentally banishing him. The White House and El Salvador presidents say they are helpless for him to return.
