The 9th Circuit reverses the verdict and allows Trump to maintain his troops in Los Angeles – NBC Los Angeles

California Gov. Gavin Newsom asked the court earlier this week to put an emergency halt on the troops supporting federal immigration agents in Los Angeles. California has called for a limit to the scope of federally activated National Guard and Marine Corps duties. The National Guard is usually revitalized by the governor at the request of local governments. President Trump has revitalized more than 4,000 National Guard members and 700 Marines over objections from city and state leaders. As of Thursday morning, no Marines had been found in Los Angeles yet, and National Guard forces had limited involvement with protesters. Local law enforcement agencies like LAPD are responding to protests and violence that are concentrated in their downtown Los Angeles pockets. A city of about 4 million people, including 500 square miles, has declared a limited curfew in a one-square-mile section of downtown.

The US military, which operated in Los Angeles, will remain in Los Angeles.

The 9th Circuit Court of Appeals suspended its lower court decision Thursday night. This temporarily blocked the Trump administration’s US security forces operations, while President Trump ordered President Trump to return to Gov. Gavin Newsom.

“A request for administrative stay is permitted. The District Court’s temporary restraining order of June 12, 2025 is temporarily pending further order,” the Court of Appeals said.

The pending order by the 9th Circuit also means the Trump administration is keeping around 4,000 California State Guard troops and 700 Marines under its control until further notice.

The Court of Appeals will hear the matter on Tuesday, June 17th.

Earlier Thursday, District Judge Charles Breyer ruled that President Trump had surpassed his authority in a 36-page ruling after hearing debate over California’s demand to limit the scope of the National Guard and Marines’ mission in Los Angeles as a demonstration over immigration enforcement.

Judge Breyer’s order was scheduled to go into effect at 12pm on Friday in California until an intervention by the Court of Appeal.

In response, the California Attorney General’s Office opposed the Court of Appeal in a filing filed a few minutes later.

“Administrative stays are unnecessary and unfairly unfair in light of broad reasoning by the district courts, particularly the consequences of irreparable harm to the state in the absence of injunctive relief,” the state DOJ wrote. “There are also serious questions regarding this Court’s appeal jurisdiction over defendant’s appeal from a temporary restraining order.”

The Court of Appeals will hold a remote Zoom hearing on June 17, 2025 at 12:00 PM PDT.

When California filed the lawsuit this week, the Trump administration called California’s legal moves “a crude political stunt that puts America’s lives at risk.” In a statement, Ice said the military is providing security to federal facilities and protecting federal officers.

The federalization of security guards and the revitalization of the Marines are closer to engaging in law enforcement measures like deportation, as Trump has promised as part of his deportation bullet. Security guards can temporarily detain people attacking officers, but will be arrested by law enforcement.

Sen. Chris Murphy of D-Connecticut asked Secretary of Defense Pete Hegseth about the use of the National Guard in Los Angeles compared to what happened at Capitol on January 6, 2021.

Trump has revitalized more than 4,000 National Guard members and 700 Marines over objections from city and state leaders. Typically, the governor will activate the California National Guard at the request of the local government. Authorities say the Marines have been trained for two days at a Southern California base and could be on the streets of Los Angeles within a day.

As of Thursday morning, no Marines had been found in Los Angeles yet, and National Guard forces had limited involvement with protesters. Guard members are stationed primarily outside federal property, such as the Metropolitan Detention Center in downtown Los Angeles.

“It’s not normal for the military to be deployed on the streets of U.S. cities,” Mayor Bus said Thursday.

On Wednesday, federal authorities announced accusations against the two men of throwing Molotov cocktails to law enforcement officials during the demonstration.

Los Angeles police have reported nearly 400 arrests and detention since Saturday. Most of it was due to illegal gatherings and violations of the curfew in downtown Los Angeles, which was originally ordered Tuesday night.

The curfew area is a 1-square-mile section of downtown, located in a city of about 4 million people, including 500 square miles.

Bass said the curfew is likely to be extended “a few days.”

California Gov. Gavin Newsom has given harsh criticism about the Trump administration’s policies and tactics as National Guard and Marine members were sent to Los Angeles amid ice raids and protests.

“If there’s a continuing raid, if there are soldiers marching up and down our streets, I’d imagine a curfew would continue,” said Los Angeles Mayor Karen Bass.

Newsom and Bass call Trump unnecessary and provocative use of the military. Bass said Los Angeles is the subject of a test case to determine how far the administration can go with the use of the military in civilians.

The demonstrations were taken up throughout the US, with protests appearing in more than a dozen major cities. On Wednesday, Seattle police used pepper spray to clear protesters, while Denver officers used balls of smoke and pepper to control the crowd.

The Trump administration said it was willing to send troops to other cities to help enforce immigrants and manage disability, in line with what Trump promised during last year’s campaign.

The administration highlights arrests that include undocumented individuals convicted of violent crimes. Those caught up in the nationwide attacks include asylum seekers, those who have continued visas and immigrants waiting for a day in immigration courts.
