Former in-n-out employee file accuses $3 million lawsuit of alleged discrimination against hairstyle

The former IN-N-Out employee filed a $3 million lawsuit against In-N-Out, claiming that he was discriminated against and eventually fired for his hairstyle.

Elijah Oben, a black man, filed a lawsuit in Compton Superior Court and said she was suffering from severe emotional distress, reputational damage and job loss.

He blames non-N-Out for unlawful termination, discrimination based on race, failure to prevent harassment, racial harassment, intentional violation of emotional distress, harassment, discrimination and failure to prevent retaliation.

In-N-Out declined to comment, citing the ongoing lawsuit.

Obeng said the lawsuit unfairly targeted employees to shove their hair in and wear hats issued by the company.

However, as his hair grew, Obeng said that the management had instructed him to change his hairstyle to follow the company’s policies. Specifically, he was advised to cut his hair and switch hair so that it fits under a completely even hat.

Obeng said he braided his hair to comply with the company’s policies, but management advised him to cut off his strain.

Obeng said he began experiencing a variety of treatments, including being blamed for minor violations and being scrutinized more closely and being denied opportunities for promotion and advancement.

Around May 25, 2024, Obeng said his supervisor had instructed him to go home, shave and come back. However, Obeng pointed out that he had no facial hair other than the natural sideburn, which is part of his hairstyle.

His colleagues also witnessed the interaction. Obeng said he felt “publicly humiliated” at the moment.

A few days later, Obeng was fired and claimed he had been let go due to “natural hair and resistance to discriminatory policies.” In-N-Out alleged that he was let go of the previous article, according to the lawsuit.

The lawsuit states that in-n-out is violating the Crown Act. This is to create a respectful and open workplace for natural hair. California law prohibits employers from discriminating against employees based on hairstyles and textures of hair.
