Exclusive: Biden-era decisions could prevent convicted killers from being deported from the United States, at least while a significant legal battle takes place in court.

Fox News rode alongside immigration and customs enforcement and homeland security investigations in Los Angeles, the heart of recent anti-ice civil unrest.

According to a source from DHS, the man turned out to Fox News to be a treaty against torture, “I have a cat, I have a cat.”

Specifically, he was given a DCAT – the postponement of removal under the treaty against torture means that he believes he is at risk of being tortured if he is sent back to El Salvador.

“This criminal should never have roamed the streets of Los Angeles. He is not only a member of the ruthless Threnos gang, but has also been convicted of multiple convictions for murder, assault, rape or sexual abuse of minors.”

“A very unusual Biden-era legal decision from December has allowed this dangerous criminal to live in American communities. Thanks to President Trump and the leadership of Secretary Noem, we are removing the threat of public safety as we should always be,” the statement continued.

By this order he was temporarily released by ice, but was detained the following day due to a major public safety risk.

Guevara maintains federal custody for potentially sending him to a third country and has tried with convicted criminals like the ones the US sent to South Sudan.

Last month’s flight in South Sudan came as a federal judge from Boston ruled against the removal of third-party parties. Still, the Department of Homeland Security is waiting for the Supreme Court to overturn its decision.

When Fox News asked if he was the convicted murderer, Guevara replied, “I’m free.”

Fox News reached out to his immigration lawyers asking who he was interested and there was no response yet to further details about his case. The country’s eyes turned to Los Angeles earlier this month, leading to protests and riots across the city and across the country.
