Federal officials have determined that California’s Department of Education has violated civil rights by allowing trans athletes to compete with biological women.
The U.S. Department of Education’s Civil Rights Office has found that the state’s Department of Education and the California Interstate Statistics Federation (CIF) are violating Title IX. This is a civil rights law that prohibits gender-based discrimination in educational programs or activities.
U.S. Education Secretary Linda McMahon said the state’s policy of allowing men to “stolen the praise of female athletes and to be exposed to unfair and dangerous competition insults.
“The Trump administration has relentlessly enforced Title IX protections for women and girls, and today’s findings reveal that California cannot comply with federal law obligations. States must either comply with Title IX or face the consequences.”
Title IX of the 1972 Education Amendment requires schools to ensure equal opportunities for girls, including athletic activities, but federal officials say California actively prevented equality of opportunities by “allowing men in girls’ sports and intimate spaces.”
Federal officials said they proposed a resolution agreement to allow states to voluntarily change their practices 10 days before the U.S. Department of Education took enforcement action and began proceedings with the Department of Justice.
To comply with federal regulations, states must revoke guidance on trans athletes provided to local school districts. California also must preserve all individual records, titles and awards to award all individual records, titles and awards.
In response, “it’s not likely to be a day when the Trump administration threatens to return California with “Y,” a spokesman from the governor’s office responded to the findings in a statement. This won’t stick.”
Newsom’s Office also noted that California is one of 22 states that have laws requiring transgender students to participate in sports that match their gender identity. AB 1266 was passed and signed in 2013
to laws by former Governor Jerry Brown.
According to the governor’s office, out of the 510,000 NCAA student-athletes, only about 10 are transgender.
