On Thursday, a federal judge in New Hampshire issued a preliminary injunction that blocked President Donald Trump’s executive order banning birthright citizenship and granted national class certification status to all infants affected by the order.
US District Judge Joseph Laplante said Thursday that he would issue a written ruling by the end of the day explaining his decision further. The injunction handed down also narrows the scope of the class to infants and removes parents from the case.
When issuing a nationwide injunction, Judge Laplante will award the deprivation of citizenship, as held in the 14th Amendment, and long-standing policy changes will create “irreparable damage.”
Still, it is almost certain that the Trump administration will soon sue. The Supreme Court heard about the case earlier this year, but ruled last month 6-3. The plaintiff seeking national relief ruled that he must file a lawsuit as a class action lawsuit.
But they didn’t place any emphasis on the question of birthright itself.
Signed on the first day of his second White House term, Trump’s order directs all U.S. government agencies to refuse to issue citizenship documents to children born to illegal immigrants.
