The Department of Justice has launched an investigation into Minnesota to “determine whether they are engaged in race-based and gender-based discrimination in the state’s employment practices.”
The investigation is Gov. Tim Waltz’s latest clash with the Trump administration with the state following the 2024 presidential bid failure. Minnesota’s Department of Human Services is facing disciplinary action that could include “in hiring for vacancy in underrepresented positions as it is implementing new policies that provide employment legitimacy when hiring hidden candidates,” or termination.
“Minnesotan deserves to hire state government employees on credit, not based on illegal DEIs,” Attorney General Pamela Bondi said in a statement.
“Federal law has long banned employment policies that discriminate on the basis of race and gender,” added Hermeet Dillon, Attorney General of the Department of Justice’s Civil Rights Division. “The Department of Justice refuses to tolerate such conduct and the state invites an investigation when it engages in biased employment practices related to protected characteristics.”

The Minnesota Department of Human Services said the purpose of the new “employment justification” policy is to ensure that states need to “meet responsibility for positive actions to comply with state laws, increase diversity in their workforce to reflect their client base and effectively provide services.
“The policy defines “underrepresented candidates,” including “women,” and writes racial “minorities” who are “black, Hispanic, Asian, or Pacific Islander,” “American Indian or Alaska native,” and to Minnesota Attorney General Keith Ellison on Thursday to the Cyrilene Committee of Minnesota’s Interim Commission.

“Title VII prohibits employers from discriminating against individuals based on race, color, religion, gender, or national origin. It prohibits the Attorney General from taking liability for a proper lawsuit to file an appropriate lawsuit if the Attorney General has reasonable grounds to believe that a state or local government employer is engaged in a pattern or practice of discrimination in violation of Title VII.

“Specifically, there is reason to believe that Minnesota’s Department of Human Services is involved in illegal behavior, among other things, through the adoption and future implementation of its “employment justification” policy,” he said.
The Minnesota Department of Human Services told Fox News Digital that it will “comply with all state and federal employment laws.”

“Since 1987, state law requires justification for nonconflicting action adoption against some vacant seats,” he added.
The investigation comes after the Justice Department filed a law in late June that freed and reduced illegal tuition fees in Minnesota and filed complaints alleging the law was illegal.

Ellison also announced a lawsuit against the Trump administration and the Justice Department in April, allowing the state to continue playing biologically male trans athletes in women’s sports.
