Eric Menendez is in fair condition a month before his high stakes parole hearing after being taken from prison to hospital Tuesday, according to the California Department of Amendments and Rehabilitation.
In a statement, the department did not include details on health issues, but 54-year-old Eric Menendez said last week that he was taken to hospital from the Richard J. Donovan Correctional Facility in San Diego.
“Eric Menendez was taken to an outside medical facility on July 18th,” the department said in a statement to the NBCLA. “The Medical Privacy Act limits us from providing more details, but he remains fair.”
The family confirmed with NBC News that Menendez was hospitalized with a “serious medical condition.”
TMZ reported that he was in a hospital near the prison and being treated for kidney stones, citing sources with direct knowledge.
Although painful, rapid treatment of kidney stones usually helps prevent sustained damage. Stones often form when the urine contains low water content and minerals form crystals. Treatment may require only painkillers and drinking water to help pass stones through the urinary tract. Depending on the size, location and type of stone, surgery or other treatment may be required in some cases.
Attorney Mark Jelagos told TMZ he is requesting Eric Menendez’s immediate release from prison due to his health.
“He’s undergoing treatment now,” Geragos told TMZ. “I’m calling the governor. He’s done this in the past in Covid and post-Covid days. I ask him to abandon Eric prior to the (parole) hearing.”
Eric and his brother Lyle were convicted of shotgun murders by their parents Jose and Kitty Menendez at their family’s Beverly Hills home in 1989.
The creators of the show said they had lunch with Newsom before the show came out and made a series about the Menendez brothers.
In May, the judge cut the brother’s life sentence to life in prison, and was eligible for parole, to 50 years in response to a petition for responsibilities. They will appear before the state parole board in August.
The defense attorney alleged that the brothers acted out of self-defense after years of sexual abuse by their father. Prosecutors allege that the brothers killed their parents for a multi-million dollar inheritance.
In another recent development, the judge ordered Los Angeles prosecutors earlier this month to explain why a murder conviction should not be reconsidered in light of new evidence in favor of his father’s allegations of sexual abuse. The July 7 order by LA County Superior Court Judge William Ryan responded to a habeas-protection petition filed by the Menendez brothers in May 2023, seeking a review of the 1996 conviction for the murder of their parents based on new evidence.
The brothers’ first trial hanged the judges. In the second trial, the judge ruled out a significant amount of evidence, including testimony from several families who witnessed or heard of the abuse.
The case, which was suspended at the end of last year, gained traction when Los Angeles County top prosecutor George Gascon said he would support the move. Gascon was defeated in the November election by Nathan Hochman.
