President Donald Trump faced an onslaught of legal bids to block his agenda during his second term in office, so Trump-nominated Supreme Court Judge Brett Kavanaugh spoke at the Court of Appeals for the U.S. Eighth Circuit Judicial Conference.
“The enforcement arm of both parties over the past 20 years is seeking to issue executive orders and regulations that will achieve the president’s administration objectives,” Kavanaugh said according to the New York Times.
“And I think the phrase was “pen and the phone,” whether it was President Obama, or I think President Biden or President Trump really did that more, and they were challenged pretty quickly in court,” he said.

Unlike regular Supreme Court decisions that fully explain the rationale behind the decision, high court decisions regarding emergency facilities may be unclear.
According to CNN, Kavanaugh said, “We have certainly given written opinions on the interim order dockets than in the past.”

He said that publishing written opinions could pose a “risk” of a “lock-in effect” “that does not reflect the final view,” but the report shows.
Kavanaugh described the court’s “consensus” as “very strong,” saying that nine members of the bench “see each other” and that they consider each other “patriots” and “good people.”
Trump appointed Kavanaugh to the Supreme Court during his first term.
