After Democrats filed a lawsuit over their denied access to an ice facility in Maryland, DHS has made clear some simple steps to require members of Congress to visit the facility.
According to the ICE’s Congressional Affairs Bureau website, members of Congress will simply submit their request via email at least seven days prior to their desired visit.
A spokesman for the Department of Homeland Security explained to Fox News Digital that the seven-day requirement is “preventing the President’s interference with Article II authorities to oversee the functions of the enforcement department.”
“A week is enough to ensure that the president’s intrusion into constitutional authorities,” the spokesman added, “A request to reduce that time must be approved by the secretary in order to protect the president’s Article 2 authorities.”

The spokesman also said, “ICE law enforcement saw a surge in attacks of 830% and confusion and obstruction of enforcement, including politicians themselves.”
Dozens of Democrats are suing the Trump administration for “illegal obstruction of Congressional oversight” after Democrats on Monday were denied entry into Baltimore’s ice facilities.
Maryland Democratic Sens. Chris Van Hollen and Angela, along with their representatives, also appeared in Baltimore, a Fallon federal building on Monday, but were denied entry to the building’s ice-controlled facilities.
After being denied access to the facility, the group held a press conference outside the building, and MFUME said, “We had to stand outside, knock on the door and finally sit in front of the door.”
Democrats filed a lawsuit against the administration in US District Court for the District of Columbia on Wednesday.

In response, DHS Communications assistant secretary Tricia McLaughlin told Fox News, “These members of Congress may have just scheduled tours. Instead, they’re in court to drive clicks and raise emails.”
After the incident, Ivey’s office shared a letter with Fox News Digital, dated July 21. In it, the delegation informed Noem and acting ice director Todd Lyons of their intention to visit the Baltimore facility. The letter did not appear to have requested it. James Kommer, R-KY, chair of the House Committee on Surveillance and Government Reform. and ranking member Robert Garcia (D-Calif) was also included in the letter.
A familiar with Democrats trying to visit Maryland’s facilities told Fox News Digital: “The letter sent to Secretary Noem was a notice, not a “request.” Under the law, members of the Congress do not need to be responsible for supervision, but as courtesy, we have notified DHS seven days prior to our visit.”
The person added, “Under the law, government joint branches are entitled to conduct ‘surprising’ tests to ensure that US taxpayer dollars are being properly spent.”

Commenting on the lawsuit, Mike Marinella, a spokesman for the National Republican Congressional Committee, told Fox News Digital that Democrats “have targeted men and women who ignore the border and then enforce it.”
“This is a Democrat platform and they’re not even trying to hide it,” Marinella said.
