Eric and Lyle Menendez are undergoing a parole hearing this week in the 1989 Shotgun Murder prison that could lead to freedom in decades. The path to a parole hearing was cleared when the brother, who sentenced life in prison without the possibility of parole, resented 50 years. The Lyle Menendez incident goes before the panel on Friday. The brothers will appear for a video feed hearing from the Richard J. Donovan Correctional Facility in San Diego. If parole is approved, the Parole Hearing Review Board grant will go to the lead counsel for the parole hearing prior to consideration by Gov. Gavin Newsom.

More than 30 years after Lyle and Eric Menendez were found guilty of fatally shooting their parents at their Beverly Hills mansion, one of the most infamous cases will have a chance of freedom this week.

The Menendez brothers will hold parole hearings Thursday and Friday after a LA County Superior Court judge reduced the sentence from prison for up to 50 years of parole.

Here are some things you need to know about a parole hearing:

When is their hearing?

Eric Menendez will be in front of the Parole Inquiry Committee on August 21st. Lyle Menendez will hold a hearing on August 22nd.

How much is each hearing?

On average, hearing is 2-3 hours long, but individual cases may vary.

Why did the Menendez brothers qualify for parole?

Under California’s Youthful Crimes Act, if someone under the age of 26 commits a crime, he or she may be eligible for parole. At the time of his parents’ shotgun murder, Lyle Menendez was only 21 years old and Eric was 18 years old.

What will be considered during their parole hearing?

The hearing committee, which is usually made up of a full-time commissioner and one vice-committee, considers whether the Menendez brothers pose a risk of danger to society if they are released based on the following factors:

Criminal History: Before firing his parents in August 1989, the brothers committed multiple robberies in the Calabasas area. They were both under 26 years old. Lyle was also accused of plagiarism while attending Princeton University. Self-control at the time of dedicated crime: Prosecutors said the murders of parents Jose and Kitty Menendez were carefully planned with the brothers travelling to San Diego and using fake IDs to buy two shotguns. Again, that happened when they were under the age of 26. Institutional Behavior: The brothers were captured in smuggled devices inside the prison, but they were generally praised for their “exceptional” behaviour in prisons, their lawyers said. Lyle led a support group for victims of sexual abuse while earning her bachelor’s and master’s degrees. Eric recently completed his bachelor’s degree from UC Irvine. Other factors include personal changes, release plans, and youth attack factors.

Can they be credited for their education and volunteer programs?

Yes, education, including vocational training, may encourage siblings.

Their participation and leadership in self-help programs could also help them build lawsuits for parole. For example, the brothers launched a glorification project to surround San Diego’s prisons with nature. Lyle led a support group for victims of sexual abuse, with Eric leading a class on religion.

Do brothers need to attend the hearing in person?

No, they will be present through video conferences from the Richard J. Donovan Correctional Facility in San Diego.

What happens if their parole is granted?

The chief counsel of the parole hearing will consider decisions regarding possible errors. The review process can take up to 120 days.

If the lead lawyer signs off with a parole grant, the case will be sent to Governor Newsom’s desk to confirm the 30-day case. Newsom said in his podcast he is likely to make a decision by Labor Day.

What happens if their parole is denied?

Their legal team can ask the board to review the case and request possible revisions.
