Los Angeles County’s next top prosecutor will likely seek a delay in resentencing the Menendez brothers at a hearing in December to reconsider the facts and evidence in the decades-old case, according to the Los Angeles County District. This was revealed by multiple people close to the prosecutor. Nathan Hockman told NBC News.
Officials said it was “very possible” that Hochman would ask for a postponement at a hearing scheduled for Dec. 11.
Mr Hochman said he wanted to thoroughly learn the relevant facts, evidence and law. That includes reviewing each brother’s confidential prison files and records from both trials, and speaking with prosecutors, law enforcement, defense attorneys and the victims’ families.
“Before making any decisions regarding the Menendez brothers’ case, we need to thoroughly learn the relevant facts, evidence, and law,” Hohoman Tsai said. “Only then can I make a decision.”

That could have led to the brothers’ immediate release, but that argument did not prevail as prosecutors ultimately re-sentenced them for first-degree murder.
Gascón’s campaign issued a statement Wednesday saying prosecutors met with Hochman and congratulated him on the election.
“I am incredibly proud of what we have accomplished over the past four years and am grateful to our community for being and continuing to be at the heart of criminal justice reform,” the statement said.
