According to multiple media reports, the “violent, unplanned, non-planned” rape scene is at the heart of a lawsuit filed by Kevin Costner, “Horizon: The American Saga: Chapter 2” and director of the film production company, Kevin Costner.
Devyn Labella filed a lawsuit in Los Angeles Superior Court on Tuesday, alleging that “improvised labor demand impacts” had defeated her career and harmed her forever, the Associated Press reported.
The 34-year-old stunt performer, the former gymnast has been working in Hollywood since at least 2020. Her IMDB page shows credits for stunts “Barbie”, “American Horror Story”, “Yellow Jacket” and “CSI: Vegas.”
According to the lawsuit, Labella worked as a stunt double for lead actress Ella Hunt in the second film in Costner’s Western series.
Filmed in May 2023, the film included rehearsals, meetings, the presence of intimate coordinators, and planned sexual assault scenes with minimal crew on the set, but the lawsuit instructed Costner the following day to pin Labella to the wagon and simulate rape.
Additionally, Labella and her lawyers argue that Costner called for many take while experimenting with violent behavior, failing to make it clear when the shot began or ended.
“We couldn’t escape the situation. Everything that Rebella could do was wait for the nightmare to end,” Suit says.

According to the Los Angeles Times, Costner’s attorney Martin Singer called the case a “shakedown.”
In a statement to the outlet, the singer described Labella as “a serial accuser of people in the entertainment industry,” saying that her actions contradicted her claims after her work in the film was over.
In a singer’s text message provided to The Times, The Associated Press and other outlets, Labella reportedly thanked film stunt coordinator Wade Allen for how much she learned in the film, her work and said, “Thank you for these amazing weeks!”
After allegedly unplanned rape scenes, the lawsuit ignored safeguards and allegedly violated union contracts and industrial standards, Lavera, who was reportedly “gathering herself” from Utah to return to her Los Angeles home.

According to the lawsuit, the crew reportedly had attention around the age of 34 when they returned to her set, demanding that she remained in her trailer and not be on the set, which exacerbated her pain.
Labella and her lawyers are seeking financial damages to be decided at trial, a public apology, and a judge’s order that the defendant is trained to sexual harassment and that an intimate coordinator is required for future production.
“Horizon: An American Saga” saw the four-part Western epic, which was planned for its first release in June 2024. The Box Officer’s performance delayed the immediate release of the second film, which was screened at two film festivals.
