Kilmer Abrego Garcia, a Salvador immigrant who was mistakenly deported to El Salvador before being returned to the US last week to face federal prosecution, was arrested in Nashville on Friday on human trafficking and conspiracy charges.

Abrego Garcia is expected to enter the petition to face charges for undocumented transport of immigrants and conspire with others that stem from the 2022 traffic stop.

The criminal case against Abrego Garcia, a suspected MS-13 member, comes after a well-known and prolonged legal battle against the Trump administration’s efforts to delay his deportation and return to the United States, even after the Supreme Court ordered him to “promote” his release earlier this year.

His case has become a national flashpoint in the broader battle over Trump’s Hardline immigration policy during his second White House term.

In a court filing Wednesday night, lawyers for Abrego Garcia urged Tennessee Magistrate Judge Sarah Holmes to release his client from custody while awaiting trial, claiming that the basis for the detention hearing and his allegations as a member of the MS-13 gang are useless.

“Abrego Garcia asks the court that he has been rejected in the past few months – justified proceedings,” his lawyer added, adding that there is no evidence that their client is at a flight risk, or that he has “systematically been involved in international travel in recent past.”

Federal prosecutors objected to it, urging the judge to take him into custody, and in his own submission, Abrego Garcia said, “I’ll run away,” if he wasn’t immediately taken into the ice, “There’s a big reason to run away.”

According to court documents, the Department of Justice filed the charges against Abrego Garcia on May 21. It is spurring a surge in large ju ju Investigations and questions about when the property was conducted.

Abrego Garcia’s family sued the Trump administration in March after a Salvadoran man who had illegally entered the country around 2012 and lived in Maryland was suddenly deported to El Salvador in March. The immigration judge had determined that he could be deported in 2019.

After returning to the US last week, Abrego Garcia was immediately sent to Tennessee and faced federal charges related to undocumented transport of immigrants.
