The undocumented immigrant who lived in Santa Ana for the past three years has been deported to the country he fled for due to violence and blames the CBPONE app currently operating.
Dominican Republic asylum seeker Esmarin de Jesus Peralta has come to the immigration detention cell after showing what he thought was a routine check-in with immigrant staff.
“He was shocked because he had no criminal history. He had a valid work permit, his Social Security number.
Peralta fled the Dominican Republic in 2022 for fear of violence. He was issued a work permit and a Social Security card, and the Wang showed it to the NBCLA.
The king said Peralta had worked with her as the ground keeper for Santa Ana’s housing company. He also played a minor league baseball player in the Caribbean, helping out the Little League team of King’s daughter.
But everything changed when the new Trump administration took office on January 20th, the couple said.
The Peralta CBPONE app he used for his asylum schedule no longer works. The Biden-era application, now with disabilities, was created to handle immigrants and enter the United States in an orderly manner, reducing illegal border crossings.
Peralta says the immigration officer told him to come to Santa Ana’s office on February 13th. When he got there, he was told he missed a detention hearing on January 22nd.
“The judge said the hearing was on January 22, 2025 and he told him he didn’t think so. However, he had documents indicating that his hearing was on March 25th, so he didn’t know the date of hearing,” Wang said.
ICE officials confirmed with NBCLA that Peralta had a final removal order.
“After exhausting all his due process, there was no legal basis to allow Daisy to stay in the United States,” Ice writes.
Alma Rosa Nieto, an immigration lawyer who doesn’t represent Peralta, says suspension of the CBPONE app could be a legal go-to.
“He has the right to sue this,” Nieto said. “I think this is the basis for him to appeal as CBPONE was recently cancelled, which is something this individual relied on to connect with the ice and find out when his interview was.”
Nieto added that sudden elimination of apps without notification is also the basis of the appeal of others who are suffering from similar issues.
The King says they are appealing to the Immigration Appeal Committee, and they have even gathered support signatures from the Santa Ana community,
Nevertheless, Peralta had been scheduled for a deportation flight back to the Dominican Republic a few days ago, but it was removed. He still doesn’t know why.
The NBCLA reached out to the ice for comment but has not yet received a reply.
“He continues to ask for updates, and they just tell him what they don’t know,” the king said.
For now, Peralta is in custody in the United States to fight to stay forever in what he hopes to become his new home.
