Exclusive: Chinese-made nicotine and e-cigarette products illegally flood the US market under former President Joe Biden, putting both adults and children at risk, raising “an urgent threat to US sovereignty, public health and law enforcement capabilities.”

In an interview with Fox News Digital, chairman of the coalition for smarter regulation of nicotine, he said that even if the Biden administration cracked down on “reputable” companies like Juul, Chinese companies had no action to control the flow of non-brand competitor products manufactured and exported by the US by Chinese companies.

“The Biden administration had no policy to enforce laws at the border, and that’s where growth really came from,” he explained, adding, “Not only did they not speak out against them, they didn’t try to enforce them.”

According to Burr, Brian King, director of the FDA’s Cigarette Products Center (CTP) in Biden, has special responsibility for overseeing institutions that are crippled by omission.

However, a King spokesman vehemently denied Barr’s allegations, telling Fox News Digital that “the claim that there were no attempts to enforce is not in line with the facts.”

Burr said that about 85% of the steam and e-cigarette products currently sold in the United States were either illegal or fraudulent as the Biden FDA failed to enforce the law.

Now, Barr is urging the Trump administration to be proactive in fixing China’s nicotine problem, which was unleashed by Americans under Biden.

Burr wrote to Trump’s FDA commissioner Martin McCurry, as well as Robert F. Kennedy Jr. of the Department of Health and Human Services and U.S. Attorney General Pam Bondy, urging markets to take urgent action to “restore order” by reforming the government’s review process for nicotine and e-cigarette products and fully strengthening the responsibilities of other directors.

In his letter, Barr describes the United States as “in the midst of a crisis caused by the free flow of illegal nicotine products into the US market, mostly being supplied by Chinese companies that are deliberately breaking US laws.”

“During the Biden administration, illegal Chinese vaping products have begun to flood our markets without regulatory oversight or consumer protection,” Burr wrote. “These illegal steam products produced overseas without meeting FDA safety standards or general tobacco products’ manufacturing practices have intentionally circumvented compliance with the law, many of which are intentionally sold to minor users with attractive young people, such as gummy bear flavors and gaming device screens.”

Burr further said that manufacturers of illegal vaping products often use fraudulent shipping declarations and misclassified customs codes to avoid US customs and trade laws.

“President Trump has justified warning that counterfeit medicines often associated with the People’s Republic of China threaten the safety and safety of Americans,” he wrote. “The Food and Drug Administration (FDA) has the opportunity to address similar crises in the nicotine market by moving forward with a modern, common-sense approach to regulating nicotine products and effectively enforce the tobacco control law (TCA) and restoring order to the market.”

To this end, Burr urged the FDA to “advance a comprehensive and effective regulatory framework.” It consists of streamlining the FDA’s approval process for less-employed nicotine products, providing clear regulations to the industry, enforcing laws against companies selling illegal products, and providing useful information to register as excluded from adult smokers using the product. In response, a spokesman speaking on King’s behalf told Fox News Digital that “the claim that there were no attempts to enforce is not in line with the facts.”

They listed 30 different enforcement measures that government agencies took based on King’s term in 2023 and 2024, from sending warning letters to potential offenders to deny marketing requests to non-compliant manufacturers.

“In the past few years, the FDA’s Tobacco Products Center has taken many first-time compliance and enforcement measures, including establishing a joint interurgence task force and carrying out multiple targeted enforcement operations for illegally imported e-cigarettes in coordination with US customs and border protections. Unauthorized, disposable e-cigarette brands used by young people,” they said.

“The FDA and other agencies should implement comprehensive enforcement measures based on these efforts against illegal e-cigarettes, particularly those popular among young people,” the spokesman said.
