Lawyers and activists in federal court on Thursday said the migrants were detained on ice shortly after they left court.
Immigration attorney Emily Witzel has been practicing her legal field for 12 years. She said she has reportedly never seen anything like the scene this week in San Diego and reportedly.
The ice agents waited just outside the courtroom and arrested people who appeared for their hearing. The judge had been told by the federal government to end the cases of some people, leaving him vulnerable to arrests as soon as he left the court. Once detained, they fall into a fast pursuit of being deported under the ice, known as “quick removal.”
“I saw the door open and waited for the ice agents to pick them up,” Witzel said. “The lack of notifications and even basic human decency are extremely shocking to all of us.”
According to a statement from ICE regarding the practice of rapid removal, “The immigration judge has considered the DHS motion to dismiss the proceedings and agreed that dismissal would be appropriate in these cases.”
ICE said people are in custody as they are waiting for removal from the US.
The Trump administration has broadened the scope of those eligible for rapid removal. Immigrants without proper documentation that cannot prove they have been in the US for more than two years could be deported without hearing.
“It’s a complete disregard by the government about the rights to legitimate processes,” said activist Pedro Rios.

Beyond those who have arrived within the last two years, rapid removal could be applied to nearly 1 million people entering under the Biden administration using the CBP One app. However, people still have the right to interview with asylum officers.
Wietzel doesn’t think this will serve as a backlog of 4 million lawsuits in immigration courts, but he believes it will instill fear and stop people from appearing in court.
“There were people who were arrested yesterday, but I never thought this would happen to them. They either go home, or the kids are back from school and they’re not there anymore,” Wietzel said.
