Court hearing revives legitimate fight over Trump’s deportation of Venezuela

US District Judge James Boasberg hears from immigration lawyers and the Trump administration on Thursday as he weighs new facts and allegations at the heart of one of President Donald Trump’s biggest immigration cases.

Boasberg did not immediately inform him which movements to consider at the hearing.

But after Boasberg found himself at the heart of Trump’s rage, an attack on so-called “activist” judges attacked El Salvador earlier this year following a temporary restraining order that stolen the 1798 wartime Chinese law, a temporary restraining order that stolen Trump’s use of alien enemy laws.

Boasberg also ordered that all planes bound towards El Salvador be returned to US soil “quickly” and “quickly” but that didn’t happen.

His emergency order, first brought before the court on March 15, touched on the complex legal narrative that ultimately produced dozens of federal court agendas across the country, prompting the Supreme Court on two separate occasions that rushed removals violated legitimate process protections under the U.S. Constitution.

As a result, Boasberg emerged as a man at the heart of legal fallout.

The order itself has been a bit of a holding pattern, but while the District of Columbia’s U.S. Circuit Court of Appeals for the District of Columbia maintained the order when it agreed to consider the ruling two months ago, Thursday’s hearing could bring back the fiercely divisive court battle once again.

Boasberg is expected to consider plaintiffs’ claims to resume limited findings, citing new evidence, including a recent UN report that the United States retains sole liability and custody for immigrants transferred to CECOT, according to Salvador officials. Other submissions include a whistleblower report from former Justice Department attorney Elles Roubeni.

Trump administration officials repeatedly exploited Boasberg as an “activist judge.” This is the term adopted for judges who suspended or blocked Trump’s sweeping policy priorities enacted by the executive order. Trump himself raised the idea that Boasberg could be fired up earlier this year, urging Chief Justice John Roberts to issue a rare public warning.

Tensions between Boasburg and the Trump administration began to heat earlier this year after the Trump administration determined that it had demonstrated a “unwilled neglect” to his orders that Boasburg found a possible cause for him to retain the Trump administration on a minor empty criminal charge for failing to return the plane to US soil in April according to emergency orders. (The Trump administration appealed the findings to the US Court of Appeals for the DC Circuit.)

In June, Boasberg ordered the Trump administration to provide all non-citizens who have been deported from the United States to El Salvador’s largest security prison, seeking habeas and giving them the opportunity to challenge their gang status.

His 69-page order began with calling for Franz Kafka’s “trial.” There, the main character, Joseph K, wakes up and finds two strange men outside his room and begins arresting him for unspecified crimes.

“That situation says that scores for Frengell Reyes Mota, Andry Jose Hernandez Romero and other Venezuelan non-citizens plummeted on March 15, 2025,” Boasberg said.

The hearing on Thursday comes amidst a gust of new reports and allegations filed by the plaintiffs in the case to resume the discovery.
