Court refuses to block Kilmer Abrego Garcia’s return from El Salvador

A federal appeals court on Thursday rejected the Trump administration’s urgent request to block a judge’s order requesting that the US government return Kilmer Abrego Garcia, a violent criminal record deported to Salvadra mega prison “Tecott Centre” (CECOT) (CECOT) last year and illegal gang-Thai immigrant.

The ruling allows the lower court order to move forward for now.

The case includes Abrego Garcia, a “Maryland man” who was deported but ordered by a district judge after a recent Supreme Court decision. The Department of Justice (DOJ) asked the U.S. Court of Appeals to lift the judge’s order to “promote” a judge’s return from CECOT, but the court on Thursday refused the request.

The three judge panel was appointed Judge Harvey Wilkinson, appointed by President Ronald Reagan, and Judges Robert King and Stephanie Soccer, respectively, and by Presidents Bill Clinton and Barack Obama, respectively.

In the court’s opinion, Wilkinson repeatedly referred to Abrego Garcia as a “resident” despite Abrego Garcia not a legal US resident.

“The government asserts the right to hide the nation’s residents in foreign prisons without the similarity of the legitimate processes that underlie our constitutional order,” Wilkinson wrote.

“This should have to shock not only the judges but also the Americans with an intuitive sense of freedom that is far from injuries.”

According to court documents and police records, Abrego Garcia has a history of domestic violence, including repeated physical abuse of his wife. The Department of Homeland Security (DHS) also identified him as a member of the MS-13 gang using the street name “Chele.”

The court said the DOJ’s request was “extraordinarily, premature” and would not hinder the district court’s efforts to implement the Supreme Court’s decision.

Attorney General Pam Bondy said Abrego Garcia will not be allowed to return to the United States unless El Salvador decides otherwise. “He’s not back in our country.”

DOJ did not immediately respond to Fox News Digital’s request for comment.
