Eric and Lyle Menendez’s res court scheduled for Thursday morning could be delayed due to a motion filed by Los Angeles County District Attorney Nathan Hochman.
Hochman filed the complaint Wednesday, saying the court wanted time to consider the parole assessment ordered by Gov. Gavin Newsom earlier this year.
In February, Newsom directed the California Parole Board to investigate whether the brothers pose a potential risk to public safety, as they allow them to be free by allowing them to be free.
The District Attorney’s Office said it hopes the authorities will complete the investigation and review it in the court.

“People believe that in this case it is very important for the court to request and obtain copies of these comprehensive risk assessments before the court holds a hearing to be resented. People require that the court continue this matter until after the court is able to obtain the copy,” Prosecutor Habib Varian said.
However, it remains unclear whether the risk assessment has been fully completed or whether the DA’s office refers only to a single component.
Less than a week later, the brother’s parents packed the same courtroom and heard the judge approve of this week’s resentment hearing.
Eric and Lyle Menendez are currently living in prison without the possibility of parole for the shotgun murder of their parents, Kitty and Jose Menendez in 1989.
They have been behind the bar for 35 years and claim they killed their parents in self-defense after years of abuse.
If Thursday’s resentment hearing progresses, it will be held around 9:30am
The brothers are expected to appear via video links from the prison.
