Biden-appointed US judge Julia Covic issued the ruling Tuesday to temporarily block the Trump administration’s move to allow only two genders, a man and a woman, on US passports.

In line with the executive order signed by President Donald Trump to the United States, the US only acknowledges two genders, and the State Department has suspended policies that eliminate the “X” designation of passport applications and allow it to be identified as opposite sex or intersex or non-binary.

The move was widely reported by the media as people who “target transgender people.” In April, Covic, a federal judge for the US District of Massachusetts, ruled that the policy would be blocked regarding the six people who sued the administration.

Her Tuesday ruling extends her previous sentence and temporarily suspends all American policies.

Covic said in her ruling that the lawsuit against Trump administration’s policies is likely to succeed as it was found to be gender-based, “arbitrarily volatile and whimsical” and “rooted in irrational prejudices against transgender Americans.”

Kobick wrote, “It is highly likely that transgender and nonbinary people with passports with gender markers that contradict gender identity and expression will experience psychological distress, suicide, harassment, discrimination and violence.”

The judge wrote that the policy would allow transgender individuals to experience anxiety and psychological distress or fears about safety when they need to travel with a gender-compatible passport corresponding to the gender assigned at birth, and primarily when it is necessary to make themselves “self” each time they present their passport.”

Trump’s order, titled “define women from gender ideological extremism and restore biological truth to the federal government,” directed enforcement agencies to “recognise two genders, male and female,” saying “these genders are unchanged and are based on basic and incontroversial reality.”

Covic said in her ruling that the government failed to demonstrate that policy was essentially related to government important concerns, but Trump’s executive order states that it is “an effort to fundamentally attack women by robbing gender, safety and happiness,” and that “the erasure of sex in language and policy has a corrosive effect not only on women as a whole.
