The Department of Justice has filed an official complaint alleging misconduct by U.S. District Judge James Boasberg. Fox News reviewed the complaints written by Attorney General Pam Bondy, Attorney General Chad Mizzel, and addressed the Supreme Court of Appeals for the Columbia District Circuit, Sri Srinivasan.
Fox News learned that the complaint was written and submitted to Attorney General Pam Bondi’s direction.

“The Justice Department honors this complaint alleges misconduct by U.S. District Judge James E. Boasberg for making inappropriate public comments about President Donald J. Trump to the U.S. Chief Justice and other federal judges who undermined the integrity and fairness of the judicial system,” Misell said.
Judge Boasberg has hosted a well-known case involving the deportation of several migrants to El Salvador, and spoke about being lightly emptying the DOJ’s lawyers due to allegations that his orders to turn around airplanes were not being followed. President Trump also made critical comments about Justice Boasberg.

The complaint commented on two opportunities that Judge Boasberg commented, and that the Department of Justice alleges that it undermines the integrity and fairness of the judiciary.
“On March 11, 2025, Judge Boasberg attended a session at the US Judicial Conference, which existed to discuss management issues such as budget, security, facilities, and more. Judge Boasberg tried to inappropriately affect Presiding Judge Roberts and about two other federal judges, a crisis.” His comments are inappropriate for some reason, but Judge Boasberg had no basis, which made them even worse. The Trump administration has always adhered to all court orders.

“Within days of these statements, Judge Boasberg began acting on the preconceived notion that the Trump administration would not comply with court orders. Initially, he lacked the authority to do so, but issued a temporary restraining order that would prevent the government from eliminating the fierce Tren de Lagua terrorists.
“Judge Boasberg’s words and actions violate the norms of the US judge’s code of conduct, erodes public confidence in judicial neutrality, and ensures formal investigation.”

The DOJ asks Judge Srinivasan to refer the complaint to the Task Force as it is essential to determine whether Judge Boasberg’s actions constitute “an entity that undermines the effective and prompt management of the court’s business.” The complaint also seeks that Judge Boasberg is taken away from a lawsuit involving Venezuelan immigrants who have been deported to El Salvador.
The case in question is JGG v Trump.
This is the second time Bondi DOJ has filed an official complaint against a federal judge. In late February, the DOJ was Nicolas Talbott et al. v. Donald J. Trump et al. This is a lawsuit filed by two LGBTQ groups challenging the Trump administration’s executive order banning transgender individuals from serving the US military.
The news of the complaint comes when the Trump administration exced or expended dozens of so-called “activist” judges who blocked or suspended part of Trump’s executive orders from enforcing it in his second White House term.
Judge Boasberg in particular found himself at the heart of Trump’s rage, and this year, the attack on so-called “activist” judges attempted to quickly expel hundreds of Venezuelan citizens to El Salvador, following his March 15 temporary restraining order attempting to block the use of alien enemies.
Boasberg had ordered that all planes bound to El Salvador be returned to American soil “quickly” and “quickly” but that didn’t happen.

His emergency order touched on the complex legal narrative that what was brought before the court on March 15th ultimately produced dozens of federal court agendas across the country, prompting the Supreme Court on two separate occasions that the rushed removal violated the protection of legitimate process for immigration under the US Constitution.
As a result, Boasberg emerged as a man at the heart of legal fallout.
Trump administration officials repeatedly exploited Boasberg for both of his orders and for trying to determine whether they acted in good faith to comply with his orders, and Trump himself came to the idea that Boasberg could be fired up earlier this year.
The complaint, which focuses on the actions of a few months ago, first taken as a judge by then-President George W. Bush in 2002 and the allegations surrounding Justice Boasberg, comes when he was able to speak up again in a major class action lawsuit filed by a lawyer representing former Cecot immigrants.
Counsel for the ACLU and others in the class asked Judge Boasberg to resume his discovery earlier this month, citing allegations from the UN report on the custody of immigrants and a recent decision to remove 252 immigrants sent from the United States to El Salvador in Venezuela based on prisoner exchanges.
When asked last week’s status hearing in court, DOJ attorney Tiberius Davis, asked whether the Justice Department would comply with the court’s order, said “if it’s a legitimate order.”
They also said they would likely seek an appeal from the High Court.
In April, Judge Boasberg also ruled that the court held the Trump administration by emptied the plane’s failure to return to U.S. soil in accordance with the March 15 emergency order, and the court said it had determined that the Trump administration had “willfully ignored” his order.

The U.S. DC Court of Appeals continued its original move in April, but has not yet proceeded with the issue.
