The Department of Justice (DOJ) has filed lawsuits against four Democratic-led states – Hawaii, Michigan, New York and Vermont, over what is called an unconstitutional climate policy that threatens the US energy independence and national security.

The move follows President Donald Trump’s Executive Order 14260, which directs federal lawsuits against state law that protects American energy from national continuity and burdens domestic energy development.

“These burdens and ideologically motivated laws and litigation threaten the independence of America’s energy and our economic and national security,” Attorney General Pam Bondy said.

“The Department of Justice is committed to “unleashing American energy” by stopping these illegal obstacles to the production of affordable and reliable energy worthy of Americans. ”

DOJ filed a complaint against the newly passed “Climate Superfund” Act Tuesday against New York and Vermont.

New York law alone seeks damages from energy companies. According to the DOJ, these laws are preempted by the federal clean air laws, violating the constitution and infringing federal foreign affairs.

“These state laws assess penalties against businesses for global activities that do not allow Congress to regulate states,” the DOJ argued in its application.

Separate lawsuits were filed Monday against Hawaii and Michigan, blocking the states from suing fossil fuel companies in state courts over past climate harms. The DOJ argues that these state lawsuits place unconstitutional burdens on energy producers.

“If a state tries to regulate energy beyond its constitutional or statutory authority, they will harm the country’s ability to produce energy and support the enemy,” Adam Gustafson said.

“The department’s application seeks to protect Americans from illegal national overcommittees that threaten the energy independence that is important to the well-being and safety of all Americans.”

The Department of Justice has asked federal courts to declare the laws of four states unconstitutional and prevent enforcement.
