Acting Assistant Attorney General Emil Bove wrote a letter Monday to representing the US attorney for the Southern District of New York (SDNY), directing SDNY to withdraw the federal case against Adams and dismiss it without prejudice.

Fox News has obtained a memo Bove written to a representative US attorney for the Southern District of New York, entitled “Dismissal Without Prejudice to Prosecution Mayor Eric Adams.”
The memo cites President Donald Trump’s executive order to combat the weaponization of law enforcement and federal immigration policies.
“You are directed to dismiss the pending charges of US v. Adams, as approved by the Attorney General… as soon as possible, subject to the following conditions: the defendant is not biased. He must agree in writing to dismiss it. The defendant must. He agrees that he is not a general political party under Hyde’s amendment… and the question is, Based on a consideration of all relevant factors, it will be reviewed by a confirmed US lawyer in the Southern District of New York following the mayoral election in November 2025. Bove’s memo comes after he and a top DOJ official recently met with an attorney representing Adams of the Department of Justice.
Adams also met with Trump at Mar Lago, Florida before taking office last month.
Adams proposed in December that he was charged after opposing the Biden administration’s immigration policy.
In a sit-in interview with Fox News’ Martha MacCallum about “Story” in December, Adams said, “I didn’t break the law.”

The move to dismiss the charges comes after Attorney General Pam Bondy established a weaponization working group last week. This will examine all law enforcement activities over the past four years to identify cases of “politicized justice.”
