Attorney General Pam Bondy announced Tuesday that the Department of Justice will file a lawsuit against Kentucky due to a policy that allows illegal immigrants living in Bluegrass State to qualify for in-state tuition at public universities.

US v. Andrew Beshear has been filed in Lexington-based federal court for the Eastern District, and is recognisable from outside the state, claiming that the law “discriminates against US citizens who were not given the same privileges and unconstitutional.”

“By providing economic benefits to illegal foreigners, we are not permitted to treat our Americans like our own second-class citizens,” Bondy said.

“The Department of Justice has just won this exact issue in Texas and is looking forward to fighting in Kentucky to protect the rights of American citizens.”

When he reached the comment, Democrat government representative Andy Besher said he had no role in creating the policy and was being enforced by the independent institution, the Post-Kentucky Education Council (KCPE).

“We were not tasked with this case, nor had we not prior notice or prior discussion with the Department of Justice about it,” Besher spokesman Crystal Staley told Fox News Digital.

Staley said the regulations were issued “before 2010” and that KCPE, not Beshear, has the sole authority to determine tuition-related residency requirements.

“The governor has no authority to change CPE regulations and should not be a party to the lawsuit.”

KCPE spokesman Melissa Young said she just discovered the lawsuit Tuesday morning and was not ready to provide detailed comments.

KCPE’s General Counsel office is still considering relevant regulations, and the agency is conducting a review before giving its formal position on the litigation, Young told Fox News Digital.

Republicans who control the state legislature have denounced Besher and said they tried to amend the law.

Burlington Rep. TJ Roberts said he wrote House Bill 352 to strip illegal immigrants from the classification of Kentucky residency, particularly for educational lessons.

He praised and criticised the governor for confronting “unconstitutional discrimination against American citizens.”

“The Besher administration has been given the opportunity to correct this wrong. First, it introduced a law that sheds light on the issue, and reintroduced it following the success of legal challenges in Texas. Unfortunately, the governor continues to ignore those opportunities, manipulates the regulatory process to promote his political measurements, and misunderstands the existence of his nation’s amsives, Kentucky,” Roberts said.
