A committee of federal judges refused to permanently appoint an interim US lawyer who reportedly claimed that his extension had been approved a few days ago.

John Salcone, who was interim by Attorney General Pamela Bondi in March to the role of US lawyer for the Upstate New York, is expected to expire Tuesday, according to WXXI.

“A US District Court judge for the Upstate District of New York refuses to exercise authorities granted pursuant to 28 US Code §546(d) to appoint US lawyers for the Upstate District of New York,” the panel said in a statement Monday without further elaboration.

Last month, Sarcone told Fox News that he was afraid of his life after allegedly facing illegal immigrants in Albany, the capital of New York. The Ministry of Homeland Security said on June 17th that Saul Morales Garcia, a native of El Salvador, “camped at Salcone with a knife, crying aggressively in a foreign language.”

Guided by the panel’s statement, Salcone received words Friday that a federal judge had voted to extend his appointment, WNYT reported.

However, the panel later issued a statement saying, “The Committee of Judges for the Upstate District of New York has not taken any action regarding US Attorneys Salcone.”

The hope of Sarcone’s permanent return to its position depends on being officially appointed by President Donald Trump and subsequently confirmed by the Senate, WXXI reported.

The northern district of New York stretches all the way from central New York to the Canadian border, including the cities of Albany, Syracuse and Binghamton.

“Thank you to Attorney General, Attorney General Bondi for trusting us in carrying out this important mission and, most importantly, President Trump, for doing my part in achieving one of your most important tasks, and regaining the public’s confidence and trust in the government and the Department of Justice,” Salcone said during his interim appointment in March.

The Justice Department said Salcone will be based in Albany and said, “He has been a committed civil servant and lawyer for many years.

“From 2018 to 2021, Sarcone has served as the Northeastern and Caribbean Regional Administrator of the U.S. General Services Bureau, oversees a large team of federal buildings and facilities, facilities, procurement and IT initiatives, and has worked with many federal agencies and courthouses in the Officers, Inc. and Commuter Railroad Employee Association.”

“Sarcone also sets up and builds general practice law firms, provides advice to small and medium-sized and family-owned businesses, deals with large real estate transactions, and litigates and arbitration in areas including business and construction disputes, insurance defense and toxic torts,” the Ministry of Justice added.

According to WXXI, attorney Michael Digiacomo was permanently appointed last month before the interim appointment expired.
