A D.C.-based federal district judge ruled that President Donald Trump fired the Special Adviser Director late Saturday evening was illegal and that he kept him in the post. The Trump administration filed a notice of appeal shortly thereafter.
Hampton Dillinger, appointed by former President Joe Biden to lead the Special Advisory Office, sued the Trump administration in federal court in Washington, D.C. after his firing on February 7th.

DC District Judge Amy Berman Jackson wrote in a filing Saturday that the court’s ruling was “illegal” and that the court’s ruling coincides with the Supreme Court’s precedent.

The Trump administration filed a notice of appeal with the District of Columbia Circuit Court of Appeals shortly after Jackson’s ruling.
Jackson said the court “delivering restrictions on the removal of plaintiffs is fatal to the critical and essential feature of the Special Adviser Bureau, devised by Congress and signed into law by the President: the court concludes that they need to stand.”

Jackson ordered the defendants in the suit, including the Director of U.S. Management and Budget and Treasury Secretary Scott Bescent. Jackson did not ban Trump.

“To say the least, it would be ironic that if the special advisor himself could be chilled in his work for fear of arbitrary or partisan removal, it would be ironic that it would be promoted by the law,” Jackson wrote.
Jackson’s decision comes after the US Supreme Court suspends the Trump administration’s efforts to dismiss Dillinger. The Trump administration had asked the High Court to overturn the temporary recovery of lower court Dillinger.
