A federal judge blocked the National Institutes of Health from implementing policies to suppress how much it pays for indirect costs associated with grants.
Last month, NIH announced plans to set a 15% rate nationwide.
“The United States needs to do the best medical research in the world. Therefore, it is important to ensure that as many funds as possible arrive at direct scientific research costs rather than administrative overhead. Therefore, the NIH imposes a standard indirect cost rate for all grants of 15% according to the authority of 45 CFR 75.414(c).

However, as the challenges unfold in court, agencies are blocked from enforcing policies.
US District Judge Angel Kelly, who issued a temporary restraining order last month, granted the interim injunction Wednesday.
“The halting life-saving clinical trials without considering current patient care, disrupting the development of innovative medical research and treatments, and the pressing risk of closure of research facilities ensured the issuance of a nationwide temporary restraining order to maintain the status quo until the issues are fully addressed before the court,” the court document declared.

“Following the full briefing by the parties and verbal discussion, followed by the accepted review of the Amikos brief, the court has granted a nationwide interim injunction,” the document states.
After then-President Joe Biden nominated Kelly to serve in the US District Court for the Massachusetts in 2021, Republican Senators of South Carolina, Chuck Grassley of Iowa and Susan Collins of Maine voted to confirm his role with Democrats.

The judge’s decision is because various states, universities and other entities challenge NIH’s attempts to adopt a 15% rate for the NIH.
