The Department of Justice can go back to home buying in Maryland from the early 2000s, which dates back to home buying in Maryland, according to a professor at Cornell Law School. Back to home buying in Maryland, it could be digging into the trail of Senator Adam Schiff’s mortgage paperwork.
“One thing they don’t want to do is bring in cases where they fail,” William Jacobson told Fox Digital in a Zoom interview, referring to the possibility that DOJ might investigate Schiff’s alleged mortgage fraud. Jacobson is a clinical professor at Cornell and director of the Securities Law Clinic.
“It either fails legally or fails in court. If you are against a major political opponent, they don’t want to lose that case. That’s part of the calculation that happens.”
Jacobson spoke about the inside and outside of the potential legal disaster of a Democrat California Senator after sending a letter to DOJ this year, claiming that Schiff forged bank and real estate documents by listing two homes from his efforts to obtain a more lucrative loan.
The DOJ has yet to say whether it will cover the case or not, but it is likely that it is digging into Schiff’s paper trail, explained Jacobson.

“I think the first thing the Department of Justice is trying to do is gather documents. There’s a paper path here. He said, ‘He said.’
When investigators examine the documents, they ask: What was his actual main residence? What did he sign? Who was there when he signed it? Did he talk to people about it?
The law professor who founded the popular conservative legal blog legal rebellion dates back more than 20 years and said that “critical paper trails” are likely to take place as they maintain close records following the 2008 financial crash.
“Mortgage companies keep all of this because of the financial crisis and other things. They have to maintain these records, and they’ll hope that the first thing the Department of Justice sees is circumstantial evidence of where Adam Schiff actually lives.”

Schiff was first scrutinized in May this year. The US Federal Housing and Finance Agency (FHFA) has written to the Department of Justice, saying that “in multiple instances” Schiff “falsify bank documents and property records to obtain more favorable loan terms and affects payments from 2003 to 2019 for Potomac’s Potomac.”
At the heart of this issue are two properties Sif purchased: The home I bought in Potomac, Maryland in 2003 was $870,000 under a mortgage agreement backed by $610,000 at a rate of 5.625% over 30 years, Burbank, California commented in 2009. According to FHFA’s letter to DOJ, Schiff reaffirmed Potomac’s property as the primary residence in mortgage refinancing documents for 2009, 2011, 2012 and 2013.
During the same time frame, Schiff gave homeowners tax exemptions on Burbank condominiums while insisting on his home as his primary residence for a $7,000 reduction in property tax, FHFA director William Prute wrote in a letter to the DOJ, citing media reports.
In 2023, the letter continued, with Schiff’s spokesman claiming that “Adam’s main residence is Burbank, California, and that’s what happens when he wins the Senate seat.”
FHFA is an independent federal agency that oversees Fannie Mae, Freddie Mac and the federal mortgage banking system.
Trump calls on longtime enemy Schiff to face prison time while evoking rumors of Russian conspiracy
In 2020, Schiff refinanced his mortgage and listed his Maryland home as a secondary residence.
Trump publicly denounced Schiff on his true socially in July, accusing him of fraud, and brought the issue back to the mass radar following 2023 news reports about Schiff’s home in Maryland and California.
“I’ve always suspected Shifty Adam Schiff was a con man,” Trump posted on Truth Social on Tuesday. “And now I know that Fannie May’s financial crimes division concludes that Adam Schiff is engaged in a persistent pattern of possible mortgage fraud.”

“Adam Schiff said his main residence is in Maryland, and when he had to live in California, he was a California lawmaker, he was in Maryland to get a cheaper mortgage and strip the United States. I always knew that Adam Schiff was a fraudster. The fraud began with a refinance of Maryland’s property on February 6, 2009, and until Maryland’s property continued its property on October 13th, 13020.
Fox News Political Newsletter: Schiff flagged for potential mortgage fraud by Trump officials
Schiff repeatedly denied and drove the charges, including refusing to answer questions from Fox News Digital about his alleged mortgage fraud on July 16, when he faced the country’s capital.
“Since I led his first round each, I have repeatedly called for Trump to be arrested for treason, so I think this is a bit of a disappointment. And this unfounded attempt at political retaliation will not hold him accountable.
“This is Donald Trump’s latest attempt at political retaliation against his perceived enemy. So, not just how weak this false allegation is, but this smear will not distract him from the issues of his Epstein files, as Trump would like,” he added.
The contradiction of Schiff’s main settlement first hit public radar in 2023. Schiff launched a ultimately successful campaign to serve in the Senate at his US home decades later. CNN has published its first news article detailing Schiff claimed his Maryland home as a major residence while also exempting homeowners tax at a Burbank condominium.
The campaign states that two properties of Schiff are listed as major residences “for loan purposes, occupied throughout the year and to distinguish them from property on vacation.”
Trump and Schiff have long been political enemies, highlighted during Trump’s first administration when Schiff served as chief manager in the first round each trial against Trump in 2020, and when Schiff repeatedly promoted allegations that the 2016 campaign conspired with Russia.
Watch: Adam Schiff’s silent after Trump accused him of mortgage fraud
A few days after President Trump first posted about Schiff’s mortgages in Maryland and California, National Intelligence Director Tarsi Gabbard reportedly shows “overwhelming evidence” that then-Barack Obama and his national security team had laid the foundation for years of Trump-Russia’s cooperation in Trump’s election after the 2016 election of former Hillary Clinton.
Sif was an incredibly voiced lawmaker amongst allegations of Russian conspiracy. Most notably, when the House of Representatives denounced him in 2023 for his promotion, which Trump’s campaign conspired with Russia. Schiff served in the House of Representatives representing California from 2001 to 2024. He was sworn as a senator after the 2024 campaign successfully campaigned in serving in the country’s Senate.

Schiff served as a ranking member of the House Intelligence Committee from 2015 to 2019 before becoming chairman of the committee from 2019 to 2023. In that role, he was kept up to date with confidential material surrounding Russian conspiracy claims.
Trump recently sparked suspicions of Gabbard’s revelation while attacking Schiff with his mortgage in another true social post.
Federal Housing Officials submit a Detective Schiff introduction to DOJ over mortgage documents
Trump ominously warned at a White House event last week that Schiff “has a lot more than his mortgage investigation.”
“He scams banks and insurance companies and the federal government, but it’s very easy. It’s a mortgage scam… but he has far worse than that. So Adam Schiff doesn’t have 100% of his mortgage scam.”
Jacobson said Democrats have spent the last decade trying to launch “laws” with Trump, and have driven himself out of trying to assert that Trump is targeting political enemies over criminal mortgage referrals.
“One of the ironies that everyone here understands is that Democrats launched a legal science campaign against Donald Trump, and it didn’t start when he took office this year. It’s been going on for 10 years,” he said.
“They used all the tools they could use to try to destroy him, including criminal prosecutions, including federal investigations. They really tried to get him. Legally, I have to prove your case politically.
President Donald Trump will arrive on the White House south lawn from Camp David on Monday, June 9, 2025.

Jacobson speculated that there is likely more problematic with Schiff in the coming days, but the potential legal case falls on the prosecutor.
“Of course, I don’t know where this is heading, but Adam Schiff looks like he’s visible to Donald Trump. It’s not surprising about that, as Donald Trump is visible to Adam Schiff for 10 years.
The Justice Department declined to comment when approached the possibility of investigating and covering the Schiff case. Schiff’s office did not respond to Fox Digital’s request for comment.
