A Georgia judge has ruled that the state Legislature can subpoena Fulton County District Attorney Fani Willis as part of an investigation into whether there was any misconduct during the prosecution of President-elect Donald Trump.
In a Dec. 23 order, Fulton County Superior Court Judge Shukla Ingram ordered Willis to submit a list of claimed privileges and objections to the subpoena by Jan. 13.
Mr Willis plans to appeal the decision.
“We believe the ruling is wrong and we intend to appeal,” former Georgia Gov. Roy Burns, who is representing Willis in the case, told The Associated Press in an email.

Earlier this month, an appeals court removed Willis from the Georgia election interference lawsuit against Trump and others, citing “alleged fraud.” The committee also noted Willis’ romantic relationship with Special Counsel Nathan Wade.
“This is a rare case in which disbarment is mandatory, and no other remedy is sufficient to restore public confidence in the integrity of these procedures,” the court said.
At the time, President Trump called the incident a “disgrace to justice.”

In August, a Republican-led Senate committee subpoenaed Willis, forcing him to testify in September. That same month, she missed a hearing when lawmakers wanted to question her.
The commission was created to investigate allegations of misconduct against Willis while prosecuting Trump over his efforts to overturn the former president’s defeat in Georgia’s 2020 election.

Mr. Willis’ lawyer, Mr. Burns, argued that the subpoena was too broad and unrelated to legitimate legislative needs, and that the Senate committee did not have the authority to subpoena Mr. Willis in the first place.
One of the issues raised is that the Georgia General Assembly’s term ends on January 13th, when members are sworn in for new terms. Republican Sen. Greg Dolezal said last week that he plans to introduce a bill to reestablish the commission at the beginning of the Georgia legislative session. Congress in 2025.

“The law is clear and the ruling confirms what we have known all along,” Dolezal wrote in a text Friday. “Judge Ingram rejected all of Willis’ arguments to avoid testifying to the committee under oath.
