Investigators on the committee were scheduled to travel to Tallahassee Jail for an August 11 sit-in with Maxwell after lawmakers voted to summon her about their close ties with pedophile Jeffrey Epstein.
In a letter sent to Comer earlier this week, Maxwell’s lawyers allegedly “were not received a fair trial,” petitioning the date of the suit before the Supreme Court is resolved.
“On July 30, the U.S. Supreme Court noticed that Certiorari’s warrant petition will be considered at its September 29 meeting. In light of this notice, the committee is willing to delay your deposit until the date that follows the court’s certificate decision,” Comer wrote.

According to a Kentucky Republican letter, Maxwell’s lawyers warned that they would call the Fifth Amendment to avoid answering questions unless certain conditions are met.
“These terms include (1) granting immunity, (2) deposition occurring outside FCI Tallahassee, (3) access to committee questions in advance, and (4) conclusions of recent appeals to the U.S. Supreme Court and potential petitions of future popularity.
He denied her request for parliamentary immunity and denied getting questions in advance, but wrote that the committee “continue to engage in good faith negotiations.”
Comer also vowed to honor the committee’s “long-standing practice of engaging in candid and detailed discussions on scoping.”
The subpoena was issued to Maxwell after a unanimous vote by both Republicans and Democrats on the committee in late July.
The motion to the subpoena was provided by Rep. Tim Burchett, R-Tenn.

“Your testimony is essential to the committee’s efforts regarding Jeffrey Epstein, including the circumstances surrounding the 2007 non-criminal agreement and Epstein’s death,” writes Comer. “These investigative efforts may be used to inform potential laws to combat sex trafficking and to improve federal efforts to reform the use of non-birth and/or judicial agreements in investigating sexual crimes.”
The letter comes hours after Fox News learned that Maxwell had been transferred from Florida to a federal prison in Brian, Texas.

Council investigators are about to speak with Maxwell about his long-standing close relationship with Epstein, who was awaiting trial on sex trafficking charges when he committed suicide in a New York City prison in 2019.
Maxwell herself was sentenced to 20 years in June 2022 for “sexual exploitation and her role in plots to abuse multiple minor girls with Jeffrey Epstein,” according to a press release from the Southern District of New York.
In a delay request, Maxwell’s lawyer argued that “the testimony she is offering now could compromise her constitutional rights, bias her legal claims and contaminate the pool of future juices.”
Maxwell had already met with federal agents last week when Deputy Attorney General Todd Blanche sat in the direction of U.S. Attorney General Pam Bondy with her in Tallahassee.

“President Trump told us to release all the credible evidence. If Gislaine Maxwell has information about the person who committed the crime against the victim, the FBI and DOJ will hear what she has to say.”
Maxwell’s lawyer told Fox News in response to Comer’s letter: “We appreciate Mr. Maxwell’s willingness to acknowledge Chair Comer’s letter and delay the deposition while the committee files lawsuits before the Supreme Court, and we will continue to engage with Congress in good faith to find ways to share her information without undermining constitutional rights.
