Republican Florida Gov. Ron DeSantis has indicated he wants to abolish the Sunshine State Red Flag Act, claiming it is violating the gun owner’s second amendment rights.
The governor made his intentions known during his state speech Tuesday.
The state’s Red Flag Act was signed by the GOV at the time. Rixcot is now a US Senator in the aftermath of the February 2018 mass shooting at Marjorie Stoneman Douglas High School in Parkland, which killed 17 people in February 2018.

This law allows law enforcement agencies to seek court orders to confiscate firearms from those who are deemed a threat to themselves or others and prevent them from purchasing more weapons in the future. This is unlike other states that have red flags laws that allow family members or roommates to petition courts to confiscate firearms.
Florida law also raised the minimum legal age for purchasing Florida guns to 21 people.
Desantis argues that Red Signal Acts, or Risk Protection Orders, are unconstitutional. He said he would have rejected the law if he was governor when it was signed in 2018.

“If you look at this red flag law passed, they can go in and say, ‘This person is dangerous and they should take out the firearm.’ This is property in addition to being related to constitutional rights,” DeSantis said. “The burden changes where you have to prove to the court that you are neither a threat nor a threat. That’s not a legitimate process.”
According to Fox 13, state records show that between July 2022 and the end of 2024 and the end of July 2024 and the end of 2024, roughly 10,000 risk protection order petitions have been filed by statewide law enforcement agencies.

No bills have been filed in either room in the Florida Legislature to repeal the Red Flag Act.
